<br />Section 1.4.3.6 <br /> <br />Expiration and Extension <br /> <br />(a) Expiration. If a plat application (of any type) has not been approved for the property <br />to be served by a utility extension within two efle year~ from the date of approval of <br />the utility extension by the Council, and if no progress has been made towards <br />completion of the project associated with the utility extension (as defined in Section <br />245.005(c) of the Texas Local Government Code, as amended) during that two year <br />period, the approved petition for a utility extension shall expire. If progress is made <br />towards completion of the project associated with the utility extension (as defined in <br />Section 245.005(c) of the Texas Local Government Code, as amended) during the <br />two-year period, but after the progress is made, no further progress is made towards <br />completion ofthe project associated with the utility extension (as defined in Section <br />245.005(c) of the Texas Local Government Code, as amended) for a period of two <br />years, the approved petition for a utility extension shall expire. In the event a plat <br />application (of any type) subsequently expires or is revoked, the approved utility <br />extension petition shall likewise expire. <br /> <br />(b) Extension. The City Council may extend the time of expiration for or reinstate an <br />approved utility extension petition for a period not to exceed one year, in accordance <br />with the procedures in Article 3, Division 5 ofthis Chapter 1. <br /> <br />***** <br /> <br />Section 1.6.2.1 Purpose, Applicability, and Effect. <br /> <br />(c) Purpose The purpose of a Subdivision Concept Plat shall be to delineate the <br />sequence and timing of development within a proposed subdivision, where the tract <br />to be developed is part of a larger parcel of land owned or controlled by the applicant, <br />in order to determine compliance with the City Master Plan and the availability and <br />capacity of public improvements needed for the subdivision and the larger parcel. <br /> <br />(d) Applicability. <br /> <br />I <br /> <br />I <br /> <br />(1) A Subdivision Concept Plat shall be required for any division ofland where <br />proposed development of the tract is to occur in phases. A Subdivision <br />Concept Plat may not be accepted for filing if the land subject to the plat <br />exceeds 300 acres for single-family residential developments, or 100 acres <br />for other types of developments. Non-residential and residential mixed-use <br />developments shall not exceed 400 total acres. Phasing for the Subdivision <br />Concept Plat shall be for not cxceed a time period offive (5) four (1) years. <br />If the land subject to the Subdivision Concept Plat is part of a larger parcel, <br />the remaining land shall be shown as a remainder tract, but shall not be I <br />included within the Subdivision Concept Plat. <br /> <br />2 <br />
