<br />I <br /> <br />(2) A Subdivision Concept Plat also shall be required for land in a Planned <br />Development (PD) zoning district. <br /> <br />(e) Effect. Approval of a Subdivision Concept Plat authorizes the subdivider to submit a <br />Preliminary Subdivision Plat or Preliminary Development Plat application for each <br />phase of development shown on the plat, subject to the schedule of development <br />approved for the land. Once a Subdivision Concept Plat has been approved, all plats <br />approved thereafter for the same land shall be consistent with the Subdivision <br />Concept Plat for so long as the Subdivision Concept Plat remains in effect. Minor <br />variations, such as slight shifts in lot lines or street layouts, between the Subdivision <br />Concept Plat and the subsequent plat application(s) shall be permitted, however, in <br />no case shall variations increase the intensity, density, number of units, and/or <br />impervious cover of the proposed development. <br /> <br />***** <br /> <br />Section 1.6.2.6 Expiration and Extension <br /> <br />I <br /> <br />(f) Time of Expiration. Expiration of the Subdivision Concept Plat shall be governed by <br />the schedule of development approved by the Planning and Zoning Commission. <br />The subdivider shall make progress towards completion of each phase of the <br />subdivision (as defined in Section 245.005 ( c ) of the Texas Local Government Code, <br />as amended) in accordance with submit and rcceive approval for a Prcliminary <br />Subdivision Plat or Preliminary Dcvclopment Plat for the first and all subsequent <br />phascs of the Subdivision Conccpt Plat within the time limits prcscribcd in the <br />approved phasing schedule. Failure to make progress towards completion of each <br />phase of the subdivision (as defined in Section 245.005(c) of the Texas Local <br />Government Code, as amended) in accordance with a platting deadline included in <br />the phasing schedule shall result in the expiration of the Subdivision Concept Plat for <br />that and all subsequent phases of the subdivision as of the fifth anniversary of the <br />date of approval of the Subdivision Concept Plat. Expiration of the Preliminary <br />Subdivision Plat, Preliminary Development Plat, Final Subdivision Plat, or Final <br />Development Plat for any phase of the Subdivision Concept Plat shall result in the <br />expiration of the Subdivision Concept Plat for all phases for which any type of <br />preliminary plat has not been approved as of the fifth anniversary of the date of <br />approval of the Subdivision Concept Plat. <br /> <br />(g) Extension. The expiration date for any phase of the development may be extended by <br />the Planning and Zoning Commission under Section 1.3.5.1. Extension of the <br />expiration date for the phase extends the expiration date for the Subdivision Concept <br />Plat for a like period.
