SCHEDULE B - MAINTENANCE AND SUPPORT SERVICES <br /> <br />(a) The Software Maintenance and Support Services will not cover Modifications or <br /> Enhancements to the Software other than as provided by Harris pursuant to this <br /> Agreement, except to make such Modifications or Enhancements perform to the standards <br /> as represented by Harris in this Agreement. <br /> <br />Additional Maintenance and Support Services. Any Software support or maintenance services <br />required by San Marcos which are outside the scope of this Agreement shall be provided by <br />Harris, in its discretion (requests for services not to be unreasonably refused), at Harris' <br />Standard Rate. <br /> <br />San Marcos Responsibilities. In order to facilitate the performance by Harris of the Software <br />Maintenance and Support Services, San Marcos shall follow the following operating <br />procedures: <br /> <br />(a) maintain adequate data backup using Harris' procedures as provided with the Software and <br /> ensuring that data entered since the last backup can be reconstructed; <br /> <br />(b) controlling the file usage and packing files, using Harris' procedures as provided with the <br /> Software; <br /> <br />(c) <br /> <br />ceasing work on the Software when San Marcos becomes aware of a Software failure <br />having occurred and seeking Harris' advice as to whether the Software can continue to be <br />safely used; <br /> <br />(d) <br /> <br />provide Harris personnel with full and free access to the equipment housing the Software, <br />including all necessary working space, heat, light, ventilation, and electrical current and <br />outlets, at no cost to Harris; and <br /> <br />(e) notify Harris forthwith of any Software failure. <br /> <br />20 <br /> <br /> <br />
