<br />I <br /> <br />I <br /> <br />I <br /> <br />Request for Reimbursement form and appropriate support documentation to indicate compliance with the <br />terms and conditions of the Development Incentive Contract with the City within 30 days of the issuance of a <br />certificate of occupancy. In the case of contracts requiring compliance with the target price, the form and <br />appropriate support documentation must be submitted within 30 days of the closing date as shown on the <br />settlement statement. Following staff review, the City will issue the applicable rebates. <br /> <br />b. For all other incentives, incentive compensation will be effective following execution of the <br />Development Incentive Agreement approved by City Council. <br /> <br />Neiahborhood Enhancement Proaram <br /> <br />1. Applicant shall file an application on a form provided by the City prior to requesting a building permit. <br />Supporting documentation that must be submitted with the application includes: <br /> <br />a. A plat/boundary survey showing the precise location of the property, all roadways within 200 feet <br />of the site, and all existing zoning and land uses on the site. <br /> <br />b. A complete legal description of the property. <br /> <br />c. A brief description of the proposed development or redevelopment project, anticipated project <br />costs, estimated development schedule, projected construction start date, and the total value of proposed <br />improvements. <br /> <br />d. The type and total value of incentives being requested. <br /> <br />e. Any other information about the proposed project which may be required by the City. <br /> <br />2. The application will be reviewed by staff for completeness and accuracy and comments will be received <br />from appropriate departments. Once this information is compiled the review comments and <br />recommendation will be forwarded to the applicant. If no further information is required and the review <br />recommendation is approval of the project, the applicant will be provided with a notice to proceed. <br /> <br />3. All requirements of all federal, state and local law shall be followed, including, but not limited to the Land <br />Development Code and Building Code. <br /> <br />4. Applications for incentives will be denied if the City finds that the application was filed after the <br />commencement of construction, alteration or installation of improvements related to the proposed <br />development or redevelopment. <br /> <br />5. The builder will pay for the fees to be rebated at the time they are due. Once the closing on the house for <br />which the fees to be rebated has occurred, the builder must submit a Neighborhood Enhancement Program <br />Request for Reimbursement form and the settlement statement from the closing. The settlement statement <br />must show that the sales price was at or below the established price point. The reimbursement request <br />form and required documentation must be submitted within 30 days of the closing date as shown on the <br />settlement statement. <br /> <br />6. Following review of the settlement statement, the City will issue the applicable rebates for projects that <br />comply with the program terms. <br /> <br />Approval of Incentives by City Council <br /> <br />1. If the City Council determines that it is in the best interest of the City of San Marcos to provide incentives <br />to a particular applicant, a resolution shall be adopted approving the terms and conditions of a development <br />incentive agreement with the applicant which will enumerate the types of incentives to be provided and the <br /> <br />Housing Infill Development Incentives Policy <br /> <br />5 <br />
