<br />4. Applications for incentives will be denied if the City finds that the application was filed after the I <br />commencement of construction or alteration or installation of improvements related to the proposed <br />development or redevelopment. <br /> <br />5. Receipt of Incentives: <br /> <br />a. For rebate incentives, the applicant will pay for the fees to be rebated at the time they are due. <br />Once the approved incentive project is completed, the builder must submit a City-Wide Incentive Program <br />Request for Reimbursement form and appropriate support documentation to indicate compliance with the <br />terms and conditions of the Development Incentive Contract with the City within 30 days of the issuance of a <br />certificate of occupancy. In the case of contracts requiring compliance with the target price, the form and <br />appropriate support documentation must be submitted within 30 days of the closing date as shown on the <br />settlement statement. Following staff review, the City will issue the applicable rebates. <br /> <br />b. For all other incentives, incentive compensation will be effective following execution of the <br />Development Incentive Agreement approved by City Council. <br /> <br />Procedure B (for projects involving 5 or more units) <br /> <br />1. Applicant shall file an application on a form provided by the City and provide the following: <br />Project Summary, including a detailed description of how the project addresses the required criteria <br />Building Elevation(s) <br />Location Map <br />Property PlaVBoundary Survey <br />Site Concept Plan <br />ProjecVUnit Mix, including all proposed uses and sizes, residential unit sizes and descriptions, etc. <br />Letter of Service Availability, Capacity and Reservation from each utility provider <br />Letter of Commitment from Lender <br />Any Letters of Support (community, government officials, etc.) <br />Memorandums of Understanding/Agreements (support services, etc.) <br />Market Analysis <br />Appraisal Report <br />Affordability Analysis <br />Project budget, including sources and uses, and development budget <br />Rental Operating Proforma (year-by-year projection of a project's expenses and income) <br />Resumes of Principles <br />Past Projects and References <br /> <br />2. The application will be reviewed by staff for completeness and accuracy and comments will be received <br />from appropriate departments. Once this information is compiled, the review comments and <br />recommendation will be forwarded to the applicant. The application, review comments and recommendation <br />will be forwarded to the City Council for consideration. After the review by the City Council members, <br />additional information may be requested of the applicant before final action is taken. <br /> <br />3. All requirements of all federal, state and local law shall be followed, including, but not limited to the Land <br />Development Code and Building Code. <br /> <br />4.
