Mayor Guerrero opened the public hearing at 7:53 p.m., there being no comments the public hearing was closed at 7:53 p.m. MOTION: Upon a motion made by Council Member Becak and a second by Council Member Thomason, the City Council voted six (6) for, none (0) opposed, and one (1) absent, Council Member Prather, to approve Ordinance 2012 -44, as previously captioned. Non Consent Agenda 19.Consider approval of Ordinance 2012 -40, on the second of two readings, adopting a budget in the sum of $160,883,043 for the Fiscal Year beginning on October 1, 2012 and ending on September 30, 2013; authorizing certain adjustments to the budget with the approval of the City Manager; approving Fiscal Year 2012 -2013 Capital Improvements Program Projects; including procedural provisions, and providing an effective date. MOTION: Upon a motion made by Council Member Thomaides and a second by Council Member Porterfield, the City Council voted six (6) for, none (0) opposed, and one (1) absent, Council Member Prather, to approve Ordinance 2012 -40, as previously captioned. The motion carried. 20.Consider approval of Ordinance 2012 -45, on the second of two readings, setting the Tax Rate for the 2012 tax year at 53.0U on each $100 of taxable value of real and personal property that is not exempt from taxation; levying taxes for the use and support of the Municipal Government of the City for the Fiscal Year beginning October 1, 2012, and ending September 30, 2013; providing a Sinking Fund for the retirement of the bonded debt of the City; including procedural provisions; and providing an effective date. MOTION: Upon a motion made by Council Member Thomaides and a second by Council Member Porterfield the City Council voted six (6) for, none (0) opposed, and one (1) absent, Council Member Prather, to approve Ordinance 2012 -45, as previously captioned. The motion carried. 21.Consider approval of Resolution 2012 -116R, approving a Meet and Confer Agreement between the San Marcos Professional Firefighters Association Local #3963 and the City of San Marcos, and declaring an effective date. MOTION: Upon a motion made by Council Member Thomaides and a second by Council Member Scott, the City Council voted six (6) for, none (0) opposed, and one (1) absent, Council Member Prather, to approve Resolution 2012 -116R, as previously captioned.
