SECTION 2. Chapter 82, Article 4, of the San Marcos City Code is amended by adding Sections 82.174, 82.175, 82.176, 82.177, 82.178, 82.179 and 82.180 to read as follows: Sec. 82.174. Immobilization of vehicles. ísl Whenever it is determined that a motor vehicle has accumulated three or more outstandina parkina citations. the vehicle may be immobilized or towed after notice and oppoFtunity for a hearina has been provided to the last known reaistered owner of the motor vehicle. The term "outstandina parkina citation" means parkina citations for which a summons may ~ssued...Y.Q.Qer Secljon 82. '1...§l.(Q1 ßù The Clerk of the Municipal Court will send written notice by certified mail. return receipt reQuested. to the last known reaistered owner of a vehicle which has accumulated three or more outstandina parkina citations. The notice shall contain at a minimum the followina information: ill The vehicle license plate number: ~ The name of the last reaistered owner of the vehicle: @} The date issued. fine amounts. costs and fees for all outstandina parkina citations: ~ A statement indicatina that a reQuest for a hearina to determine whether or not the motor vehicle will be immobilized or impounded must be made to the Clerk of the Municipal Court in writina. without reQuirement of bond. within 15 days after the date the notice was mailed: .@ A statement indicatina that failure to reQuest a hearina before the expiration of the 15 day period. or failure to appear at a reQuested hearina wi II constitute a waiver of the opportunity to oppose the proposed impoundment or immobilization: and @ A statement indicatina that the reaistered owner of the vehicle. in addition to beina responsible for all outstandina parkina citations. wi II be responsible for all fees and costs incurred in immobilizina and impoundina the vehicle. includina storaae fees.
