Reclaimina immobilized or impounded vehicles. <br /> Íê1 The owner or a person with the riaht to possession of a vehicle which has <br /> been immobilized or impounded under this Article mav reclaim the vehicle bY appearina <br /> at the Municipal Court. Monday throuah Friday. between the hours of 9:00 a.m. and 5:00 <br /> p.m.. and durina all other times at the Police Department. and meetina the followina <br /> reQuirements: <br /> <br /> ill Present satisfactory evidence of the person's identitv and of the <br /> person's ownership or riaht to possession of the vehicle: and <br /> <br /> @ Pay the accumulated amount of fines. costs and fees related to the <br /> vehicle: or <br /> <br /> .@l Pay the immobilizina fee and arranae a payment schedule for the <br /> remainina fines. costs and fees related to the vehicle: or <br /> <br /> ffi Post a cash bond for the accumulated amount of fines and costs for <br /> all outstandina parkina citations related to the vehicle. have a trial <br /> date set for the parkina citations. and pay all fees related to the <br /> immobilizina and impoundment of the vehicle. <br /> <br /> ßù Upon compUance w~on (a). the person will be authorized to <br /> reclaim the impounded vehicle or to have the immobilization device removed. <br /> .(çl The Municipal Court Judae is authorized to issue a written order releasina <br /> an imoounded vehicle to its owner or to a person found bY the court to have <br /> the riaht to possession of the vehicle. Nothina in the order shall authorize <br /> or imply the waivina of costs and fees associated with the impoundment and <br /> storace of the vehicle. <br /> Sec. 82.180. Release of impounded vehicles. <br /> Upon presentment of either a sianed release from the Municipal Court <br /> Judae. Municipal Court Clerk or the San Marcos Police Department and proof of identity <br /> to the person in possession of the vehicle. the impounded vehicle may be released to the <br /> person indicated in the order. <br /> SECTION 3. If any word, phrase, clause, sentence, or paragraph of this <br /> ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the <br /> other provisions of this ordinance will continue in force if they can be given effect without <br /> the invalid portion. <br /> SECTION 4. All ordinances and resolutions or parts of ordinances or <br /> resolutions in conflict with this ordinance are repealed. <br /> SECTION 5. Any person violating a provision of this ordinance commits a <br /> misdemeanor and is subject to the penalties provided for in Sections 1.015 or 82.159, <br /> where applicable, of the San Marcos City Code upon conviction. <br /> SECTION 6. This Ordinance takes effect ten (10) days after the date of its final <br /> - 4 - <br />
