105 LICENSE AGREEMENT THE STATE OF TEXAS § § KNOW ALL PERSONS BY THESE PRESENTS: COUNTY OF HAYS § The City of San Marcos (the "Licensor") is the owner of the real property in the City of San Marcos described in Exhibit "A" (the "Practice Field"), which is an area of the Licensor's park property. In consideration of the agreements made by Southwest Texas State University (the "Licensee"), the Licensor grants a license to the Licensee to utilize the Practice Field under the following terms and conditions. 1. The Licensee agrees that all construction and maintenance performed for or on behalf of the Licensee under this agreement shall be in compliance with all police, traffic, building, fire and health regulations of the State of Texas and City of San Marcos. 2. The Licensor agrees not to assess a fee for the authorization granted to the Licensee under this agreement. 3. The Licensee agrees that it will be solely responsible for all personal injuries and property damage caused by the negligence of the Licensee, its officers, agents or employees in connection with the Licensee's use or maintenance of the Practice Field. 4. The Licensee's time periods for exclusive use of the Practice Field will be limited as follows: a. Use by the Licensee's Health, Physical Education and Recreation Department: Monday through Friday, 8:00 a.m. until 2:00 p.m. b. Use by the Licensee's Athletic Department: 1. Fall: From 7:00 a.m. to 6:00 p.m. each day during the Licensee's fall football camp during August, and from 2:00 p.m. to 6:00 p.m. Monday through Friday during the Licensee's fall semester; 2. Spring: From 2:00 p.m. to 6:00 p.m. Monday through Friday during the last three weeks in March and during the month of April for the Licensee's spring football practice; and 3.
