<br /> f <br /> 106 <br /> RESOLUTION 1998- h 7 R <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> SAN MARCOS, TEXAS, APPROVING THE TERMS AND <br /> CONDITIONS OF A LICENSE AGREEMENT BETWEEN THE <br /> CITY AND SOUTHWEST TEXAS STATE UNIVERSITY FOR <br /> THE CONSTRUCTION AND MAINTENANCE OF A NON- <br /> POTABLE WATER SUPPLY LINE UNDERNEATH SESSOM <br /> DRIVE; AUTHORIZING THE CITY MANAGER TO EXECUTE <br /> THE AGREEMENT ON BEHALF OF THE CITY; AND <br /> DECLARING AN EFFECTIVE DATE. <br /> RECITALS: <br /> 1. The city is the owner of the street right-of-way in the 100 block of Sessom <br /> Drive (the "License Area") in San Marcos, Hays County, Texas. <br /> 2. Southwest Texas State University (SWTSU) owns property adjacent to the <br /> License Area upon which its non-potable water system improvements are proposed to be <br /> located. <br /> 3. A six (6) inch diameter water supply line is to be installed from Spring Lake <br /> Dam to the East Chiller Plant by a bore of Sessom Drive. Sessom Drive is not to be open- <br /> cut for this utility installation. <br /> 4. The License is for the purpose of the City granting permission to the SWTSU <br /> to use the License Area for its construction and maintenance activities for the non-potable <br /> water supply line. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> PART 1. The terms and conditions of the License Agreement attached to this <br /> Resolution between the City and SWTSU for construction and maintenance of non-potable <br /> water system improvements underneath Sessom Drive are approved. <br /> PART 2. The City Manager, Larry D. Gilley, is authorized to execute this Agreement <br /> on behalf of the City. <br /> PART 3. This Resolution shall be in full force and effect from and after its passage. <br /> ADOPTED this 23rd day of March, 1998 <br /> ~~.~ <br /> Billy G.
