<br /> 107 <br /> LICENSE AGREEMENT FOR THE CONSTRUCTION AND <br /> MAINTENANCE OF NON-POTABLE WATER SYSTEM IMPROVEMENTS <br /> STATE OF TEXAS <br /> COUNTY OF HAYS <br /> This Agreement is made this 24th day of March , 1998, <br /> <br /> between the CITY OF SAN MARCOS, TEXAS, (the "City"), and SOUTHWEST <br /> TEXAS STATE UNIVERSITY, hereinafter called (the "Licensee"). <br /> RECITALS <br /> 1. The City is the owner of the area of street right-of-way described on the <br /> attached Exhibit A, located in the 100 block of Sessom Drive in San Marcos, Hays <br /> County, Texas (the "License Area"). <br /> 2. The Licensee owns property adjacent to the License Area upon which its <br /> non-potable water system improvements are located. <br /> 3. A six (6) inch diameter water supply line is to be installed from Spring Lake <br /> Dam to the East Chiller Plant. The water supply line is to be installed by a bore of <br /> Sessom Drive. Said Sessom Drive is not to be open-cut for this utility installation. <br /> 4. This License is for the purpose of the City granting permission to the <br /> Licensee to use the License Area for its construction and maintenance activities, subject <br /> to the terms and conditions ofthis License. <br />
