<br /> ARTICLE 14 <br /> BASIS OF COMPENSATION <br /> 14.1 The City will compensate the Engineer, in accordance with Article 5, Payments to <br /> the Engineer, and the other terms and conditions of this Agreement, as follows: <br /> 14.2 The total of all amounts to be paid to Engineer for Preliminary Design Services as <br /> described in Exhibit A, will not exceed $37,331.00. This total amount will not be exceeded <br /> by Engineer without a written amendment to this Agreement approved by the City. Upon <br /> completion of Preliminary Design, the City and Engineer will negotiate a fee for the <br /> remaining Basic Services, which include final design and construction phase services, <br /> prior to Engineer proceeding with those services.
