No:~ing in this <br />section preempts State licensing laws. When contracting ~=r <br />architectural and engineering (A/E) se=vices, geographic :ocation may be <br />a selection criteria provided its application leaves an appropriate <br />number of qualified firms, given the nature and size of the project, to <br />compete for the contract. <br /> <br />(3) Grantees will have written selection procedures for [Prev Hit1 [Next !Ht]~roc <br /> <br />(i) IncorDorate a clear and accurate descriDtion of t::e technical <br />requirements for the material, produce, or service to be procured. Such <br />description shall not, in competitive procurements, con:ain features <br />~hich unduly restrict competition. Tte des=ription may include a <br />statement of the qualitative nature 0: the material, pr~d~ct or service <br />to be procured, and ~hen ne=essary, s~all set forth those minimum <br />essential characteristics a~d standaris to h~ich it must =onform if it <br />is to satisfy its intended use. Detai~ed product specifi=ations should <br />be avoided if at all possible. When it is impractical or uneconomical to <br />~ake a clear and accurate descriotion of :~e technical re=uirements, a <br />brand name or equal description ~ay be used as a means to"define the <br />performance or other salient requirer:-.en:s 0: a [?re'¡ :-:i::' '~:ex: :-:i:1procurement. 7::-.~ <br />features 0: the named brand h~ich mus:: be ~e: by offerors shall be <br />clearly seated; and <br /> <br />(ii) Identify all requi:-er:1ents ',,::i=h ::-.e offeror:; must fulfill and <br />all other :ac:ors to be used in evaluating =ids 0':: proposa::;. <br /> <br />(4) Grantees and subgrantees ~ill ensure that all prequalified lists <br />of persons, firms, or products which are used in ac~..liring goods and <br />ser,ices are current and in=lude enou9:: qualified sources to ensure <br />maximum open and free compe:ition. Also, s=antees and s~=grantees will <br />not preclude potential bidders from qualifying during the solicitation <br />period. <br /> <br />(d) Methods of [?rev Hit] [Next Hi:]procurement to be :ollo"'ed.
