<br />3. Lessee's Access to Leased Premises: <br /> a. Lessee shall have the unrestricted right to enter or leave the premises where <br /> the equipment is located. Lessee agrees to take, at its expense, all measures <br /> and precautions necessary to render its equipment and Lessor's premises <br /> inaccessible to Unauthorized persons. Lessor agrees that it will not give <br /> unauthorized persons access to Lessee's equipment. <br /> b. Lessor shall provide Lessee with road access to the Leased Premises <br /> throughout the term of this Agreement. <br />4. Governmental Approvals: <br /> Lessee shall be solely responsible for receiving approval from all governmental and <br /> regulatory authorities for the installation, use, maintenance, and removal of its <br /> equipment upon the Leased Premises. If Lessee is unable to secure all appropriate <br /> approvals, this Agreement may be canceled by Lessee by providing 30 days written <br /> notice to Lessor and all advance rentals paid by Lessee shall be refunded. <br />5. Term <br /> This agreement shall extend for a period of 10 years from the date refeITed to above. <br /> After the initial term of this Agreement, this Agreement will automatically be <br /> renewed for 5-year periods on each successive anniversary of this Agreement unless <br /> one party notifies the other at least 180 days in advance of an anniversary date of its <br /> intention not to renew the Agreement. <br />6. Consideration <br /> As consideration for this Agreement, Lessee shall pay Lessor the sum of $4375.80 <br /> per year, payable in semi-annual installatments every six months in advance. <br />7. Termination: <br /> a. This Agreement may be terminated at any time, without notice by Lessor <br /> should Lessor determine that the structural integral of the water tower is in <br /> question or that the water tower or any appurtenances pose an immediate <br /> threat to life and/or property, and, in such event, no compensation shall be <br /> paid to Lessee for damages to any equipment, the removal of which was <br /> necessitated by such condition. <br /> b. Either party shall have the right to terminate this Agreement at any time <br /> -2- <br />
