<br /> upon one-year's written notice of its intention to so terminate. <br /> c. TIlls Agreement may be terminated by either party upon default by the other <br /> party of any of the convenants or conditions contained in the Agreement <br /> other than a default resulting in the creation of conditions described in <br /> Section 7 a. In the event of a default by a party, the other party shall give the <br /> defaulting party written notice of default, and, upon the defaulting party's <br /> failure to cure or remedy the default, within 30 days following receipt of <br /> notice, this Agreement shall terminate immediately without further notice <br /> to the defaulting party. <br /> d. Upon any termination ofthis Agreement, Lessee shall remove its property <br /> and equipment (other than permanent improvements) from the Leased <br /> Premises within seven days following the date of termination. Lessee shall <br /> have no further claim, right, title or interest in or to any of the property or <br /> equipment remaining on the Leased Premises after that time. <br />8. Notices: <br /> All notices to Lessor shall be in writing and shall be sent by certified mail, return <br /> receipt requested, or by confirmed telefacsimile, addressed to the City Manager of <br /> the City of San Marcos, 630 East Hopkins Street, San Marcos, Texas 78666, Fax <br /> (512)396-4656. All notices to Lessee shall be in writing and shall be sent by <br /> certified mail, return receipt requested, or by confirmed telefacsimile, addressed to <br /> LCRA, Attention: Cindy Walp, P.O. Box 220, Austin, Texas 78767, Fax (512)473- <br /> 3346. Either party may designate a different address/Fax number for notice by <br /> notifying the other party in writing. <br />9. Surrender of Leased Premses: <br /> Lessee will at the expiration of this Agreement or upon any sooner termination, quit <br /> and surrender the Leased Premises to Lessor peaceably, quietly and in as good order <br /> and condition as now exists, reasonable use and wear and authorized improvements <br /> excepted. <br />10. Nondiscrimination: <br /> The Lessee shall not discriminate against any employee or applicant for <br /> employment because of race religion, sex, color, national origin, age or physical <br /> handicap. The Lessee shall include a similar provision in any subcontract it may <br /> enter into in connection with this Agreement. <br /> -3- <br />
