<br /> 101 <br /> INTERLOCAL AGREEMENT FOR <br /> WASTEWATER TREATMENT PLANT SLUDGE DISPOSAL <br /> STATE OF TEXAS <br /> COUNTY OF HA YS <br /> This interlocal agreement is entered into between the City of San Marcos (the "City") and <br /> Southwest Texas State University (the "University") as to tracts of land owned by the University to <br /> be designated under this agreement. <br /> The City and the University agree as follows: <br /> 1. Authorization Granted by University. The University hereby grants the City <br /> authorization to utilize to use tracts of land owned by the University as application sites for the <br /> City's wastewater treatment plant sludge (the "Sludge"). The University will designate specific <br /> tracts of land for this purpose in writing to the City. Tracts so designated are referred to in this <br /> agreement collectively as the "Property". The City and the University agree to use the Sludge on <br /> the Property to enhance the quality of the existing topsoil on the Property. <br /> 2. Application by City. The City will provide the labor, machinery, supplies, and equipment <br /> necessary to apply the Sludge on the Property. <br /> 3. Sludge Application Procedures. The City will perform the application procedures for <br /> the Sludge on the Property in accordance with the standard practices and methodology approved and <br /> accepted by the Texas Natural Resource Conservation Commission, as specified in the 30 T.A.C. <br /> Chapter 312 rules for Sludge Use, Disposal and Transportation and by the Texas Department of <br /> Health. <br /> 4. Maintenance of Access Roads. The City will maintain all access roads on the Property <br /> utilized by the City for the Sludge application activities in a manner that will allow for safe passage <br />
