<br /> 133 <br /> PROFESSIONAL SERVICES AGREEMENT FOR <br /> THE COORDINATION OF THE <br /> CENTRAL TEXAS HOUSEHOLD HAZARDOUS WASTE MOBILE PROGRAM <br /> This AGREEMENT is made this the 23rd day of June ,1998, between <br /> the City of San Marcos, Texas ("City"), 630 East Hopkins, San Marcos, Texas 78666 and <br /> Denise Vergez (the "Consultant"), 9709 Timber Ridge Pass, Austin, Texas 78733, for the <br /> provision of professional services for the coordination of the Central Texas Household <br /> Hazardous Waste Mobile Program for the City of San Marcos. <br /> The City and the Consultant agree as follows: <br /> ARTICLE 1 <br /> CONSULTANT'S SERVICES AND RESPONSIBILITIES <br /> 1,1 STANDARDS OF PERFORMANCE <br /> 1.1.1 Consultant will be responsible for the professional coordination services for a <br /> Household Hazardous Waste Mobile Program for the City of San Marcos (the "Project"). <br /> The purpose of this Project is to conduct a regional household waste management <br /> program which includes an educational campaign in addition to five one-day collection <br /> events. This Project is under the sponsorship of the City and will include affordable <br /> household hazardous waste collection for the City of San Marcos, Hays County, the City <br /> of Luling, and the City of Lakeway (the "Participating Communities"). This Project is being <br /> financed in part with funds from the Texas Natural Resource Conservation Commission <br /> ("TNRCC") through a grant from the Capital Area Planning Council ("CAPCO"). The <br /> Consultant certifies that it is fully familiar with federal, state and local regulations regarding <br /> household hazardous waste collection and other waste streams. Consultant is <br /> experienced and familiar with all reporting requirements to both CAPCO and the TNRCC. <br /> Consultant will perform all of its services so that the Project will proceed in accordance with <br /> the guidelines promulgated by the TNRCC and CAPCO. <br /> 1.1.2 The Consultant's services are described in Sections 1.1 through 1.9. <br /> 1.1.3 The performance of all services by the Consultant in connection with this <br /> Agreement will be by persons appropriately licensed or registered under State, local and <br /> Federal laws governing their respective consulting disciplines. In performing all services <br /> under this Agreement, the Consultant will use that degree of care and skill ordinarily <br /> exercised for similar projects by professionals who possess special expertise in the types <br /> of services involved under this Agreement. No work under this Agreement will be <br /> subcontracted by the Consultant without prior written approval from the City. Any work or <br /> services subcontracted under this Agreement shall be specified by separate written <br /> Agreement and shall be subject to each provision of this Agreement. Any provisions in this <br /> Agreement pertaining to the City's review, approval and/or acceptance of written materials <br /> 1 <br />
