<br /> 152 <br /> INTERLOCAL AGREEMENT FOR FIRE PROTECTION SERVICES <br /> This Interlocal Agreement is made and entered into this 14 t h day of July, <br /> 1998, by and between the City of San Marcos, Texas (the "City"), a municipal <br /> corporation organized and existing under the laws of the State of Texas, and the South <br /> Hays County Emergency Services District #3 (the "District"), an emergency services <br /> district operating in a geographical area of South Hays County, Texas, duly created <br /> and organized under the laws of the State of Texas. <br /> ARTICLE I. <br /> 1.01 The purpose of this Agreement is to secure to the residents of the City of San <br /> Marcos, Texas, and to the residents of the South Hays County Emergency Services <br /> District #3, Hays County, Texas, the protection of life and property from fire. <br /> ARTICLE II. <br /> 2.01 In the event of a fire or fires, within the geographical area of the District, upon <br /> request to the Chief of Police, Fire Chief or, in their absence the Shift Captain, on duty, <br /> of the San Marcos Fire Department by the Hays County Sheriff's office or the 911 <br /> Emergency System Dispatcher, firefighting equipment, if available and in good working <br /> order, and personnel, if available, of the San Marcos Fire Department will be <br /> dispatched to any point within the geographical area of South Hays County Emergency <br /> Services District #3, pursuant to this Agreement. <br /> ARTICLE III. <br /> 3.01 The South Hays County Emergency Services District #3 agrees to indemnify and <br /> hold harmless the City, its employees and Fire Department volunteers, for any loss, <br /> damage, personal injury, or death occurring as a result of the negligence of said <br /> personnel in carrying out services under Article II of this Agreement, regardless of <br /> whether such loss, damage, personal injury, or death is caused in whole or in part by <br /> - 1 - <br />
