<br /> the negligence of the City, its employees or Fire Department volunteers. <br /> ARTICLE IV. <br /> 4.01 Any dispatch of equipment and personnel pursuant to this Agreement is subject <br /> to the following conditions: <br /> (a) A request for aid shall include a statement of the amount and type of <br /> equipment and number of personnel requested, and will specify the location to <br /> which the equipment and personnel are to be dispatched, but the amount and <br /> type of equipment and number of personnel to be furnished shall be determined <br /> by the City. <br /> (b) The Officer in charge of the District shall report to the officer in charge of <br /> the City's response personnel at the location to which the equipment is <br /> dispatched. <br /> (c) The City will determine when the services of its fire fighting personnel <br /> and equipment are no longer required at the scene of a fire or when its <br /> personnel are needed within the area for which it normally provides fire <br /> protection. <br /> ARTICLE V. <br /> 5.01 Each party agrees to maintain its equipment to be used in fire protection in good <br /> working order and to ensure that its personnel are competently trained in the use of <br /> such equipment and in firefighting in general, at a level of competency no less than the <br /> standard of professional firefighting competency common to firefighting departments <br /> in the State of Texas. <br /> 5.02 South Hays County Emergency Services District #3, agrees to indemnify and <br /> - 2- <br />
