<br /> hold harmless the City, its employees and Fire Department volunteers for any loss, <br /> damage, personal injury, or death occurring as a consequence of the failure or <br /> negligence of the San Marcos Fire Department to fully comply with this Article, <br /> regardless of whether such loss, damage, personal injury, or death is caused in whole <br /> or in part by the negligence of the City, its employees or Fire Department volunteers. <br /> ARTICLE VI. <br /> 6.01 No party shall be reimbursed by any other party for any expenses and costs <br /> incurred pursuant to this Agreement, except as agreed upon by the parties in a <br /> separate agreement to be negotiated in good faith by the parties and incorporated by <br /> reference into this agreement upon execution. <br /> 6.02 The City and the District specify that the governmental functions or services <br /> provided for by this Agreement are to be paid from current revenues available to the <br /> parties and any payments contemplated under this Agreement will fairly compensate <br /> the performing party for the services or functions it performs under this Agreement. <br /> ARTICLE VII. <br /> 7.01 All equipment used by the San Marcos Fire Department in carrying out this <br /> Agreement will, at the time of action hereunder, be owned by it; and all personnel <br /> acting for the San Marcos Fire Department under this Agreement will, at the time of <br /> such action, be employees or volunteer members of the San Marcos Fire Department <br /> and acting in the scope of that employment. <br /> ARTICLE VIII. <br /> 8.01 All equipment used by the South Hays County Emergency Services District #3, <br /> in carrying out this Agreement will, at the time of action hereunder, be owned by it; and <br /> all personnel acting for the District under this Agreement will, at the time of such action, <br /> be an employee or volunteer member of the District and acting in the scope of that <br /> - 3 - <br />
