Standards for Financial and Programmatic Management <br /> <br /> PERFORMING AGENCY shall bill third party payers, at no cost to the client, for services provided under the <br /> Attachment( s). These potential payers include, but are not limited to, Medicai~ private insurance carners, and other <br /> available federal, state, local, and private funds. PERFORMING AGENCY shall become a Medicaid provider for <br /> eligible activities funded in the Attachment(s) and will maximize efforts to obtain payment from Medicaid and all <br /> other available sources. <br /> PERFORMING AGENCY, if designated a 50 I (c)(3) organization as defined in the Internal Revenue Service Code <br /> or a for-profit organization,. and its governing board, shall bear full responsibility for the integrity of the fiscal and <br /> programmatic management of the organization. Such responsibility shall include: accountability for all funds and <br /> materials received from RECEIVING AGENCY; compliance with RECEIVING AGENCY rules, policies, <br /> procedures, and applicable federal and state laws and regulations; and coITection of fiscal and program deficiencies <br /> identified through self-evaluation and RECEIVING AGENCY's monitoring processes. Further, PERFORMING <br /> AGENCY's governing board shall ensure separation of powers, duties, and functions of board members and staff. <br /> Ignorance of any contract provisions or other requirements contained or referenced in this contract shall not <br /> constitute a defense or basis for waiving or appealing such provisions or requirements. <br /> ARTICLE 12. Terms and Conditions of Payment <br /> <br /> For services satisfactorily performed pursuant to this contract, RECEIVING AGENCY will pay PERFORMING <br /> AGENCY for allowable costs. Payments are contingent on a signed contract and will not exceed the total of each <br /> Attachment(s). The PERFORMING AGENCY is entitled to payment only if the service, work, and/or product has <br /> been satisfactorily performed and authorized in accordance with this contract. <br /> (F ee-for-Service) 1999 GENERAL PROVISIONS Page 7 4/98 <br />
