<br />I <br /> <br />I <br /> <br />I <br /> <br />PROFESSIONAL ENGINEERING SERVICES AGREEMENT <br /> <br />This Agreement is made this the 18thday of April, 2007, between the City <br />of San Marcos, Texas ("City"), 630 East Hopkins, San Marcos, Texas 78666 and Baker Aicklen <br />& Associates, Inc. ("Engineer), 100 North Edward Gary Street, suite 101, San Marcos, Texas <br />78666 for the provision of professional engineering services in connection with the Master Plan <br />for The Village of San Marcos - Phase 1 (the "Project. <br /> <br />The City, and the Engineer agree as follows: <br /> <br />ARTICLE 1 <br />ENGINEER'S SERVICES AND RESPONSIBILITIES <br /> <br />1.1 STANDARDS OF PERFORMANCE <br /> <br />1.1.1 The Engineer will provide a concept plan, watershed protection plan phase 1 permit, and <br />an environmental constraints analysis under this Agreement for the Project. The Project area is a <br />29-acre tract of land located between Reimer Avenue and Suttles Avenue, east of Hunter Road in <br />San Marcos, Texas. The property is owned by The Village of San Marcos, Inc. ("The Village") <br />a Section 501 (c)(3) corporation. It is anticipated that the Family Justice Center, to be operated <br />by the City of San Marcos Police Department, will eventually be constructed on The Village <br />campus in accordance with the terms of The Village's adopted Articles of Incorporation and <br />Bylaws. The development of this area will occur in at least three separate phases. The Project <br />referenced in this Agreement only includes Phase I services. Funding for this Project is being <br />provided by the United States Department of Housing and Urban Development ("HUD") through <br />the Community Development Block Grant ("CDBG") Program. The Consultant will perform all <br />of its services so that the Project will proceed in accordance with HUD guidelines. <br /> <br />1.1.2 The Engineer's Basic Services consist of the services described in Sections 1.1 through 1.4 <br />and include normal civil engineering services as well as those engineering services to be <br />performed through the following consulting disciplines as subcontractors to the Engineer: <br /> <br />Environmental Engineering - Whitenton Group, Inc. <br /> <br />1.1.3 The performance of all services by the Engineer in connection with this Agreement wilI <br />be by persons appropriately licensed or registered under State, local and Federal laws governing <br />their respective consulting disciplines. In performing all services under this Agreement, the <br />Engineer will use that degree of care and skill ordinarily exercised for similar projects by <br />professional Engineers who possess special expertise in the types of services involved under this <br />Agreement. <br /> <br />1.1.4 No work under this Agreement will be subcontracted by the Engineer without prior <br />written approval from the City.
