57. <br />Regular Meeting May 12, 2003 Page 11 <br /> <br />Mayor Habingreither introduced a discussion regarding Sign Ordinance <br />options. Mr. O'Leary stated Staff is unclear on how to proceed on this <br />item. Mr. Mihalkanin stated he would like to hold a public hearing to <br />solicit comments. Ms. Narvaiz stated she would like to send this <br />Ordinance back to the Planning and Zoning Commission. She also stated if <br />there is not a consensus by the Council, then she is in favor of lifting <br />the moratorium and leaving the Ordinance as is. Mr. Diaz asked the City <br />Attorney about his participation in this discussion. Mr. Mark Taylor <br />stated since this Ordinance is pertaining to billboards and off-premise <br />signs, and Mr~ Diaz advised he was not involved with billboards and off- <br />premise signs, then Mr. Diaz is not in conflict and can participate. Mr. <br />Diaz stated he is in favor of lifting the moratorium. Mr. Thomaides <br />inquired when the Planning and Zoning Commission first looked at this <br />item. Mr. O'Leary stated the Planning and Zoning Commission has looked at <br />this in the past, but most recently was 6 months ago. Mr. Thomaides <br />stated he feels the City should get the most comments possible and is in <br />favor of public hearings. Ms. Narvaiz stated she feels if this Ordinance <br />was sent back to the Planning and Zoning Commission, then they could have <br />more public comment time. Mr. Mihalkanin stated the Council is running <br />out of time, as the moratorium ends in the middle of July. He does not <br />feel the moratorium should be extended again. He stated he feels this <br />should not be sent back to the Planning and Zoning Commission, because <br />they have already held public hearings. Ms. Narvaiz stated if the Council <br />is not in favor of sending this Ordinance back to the Planning and Zoning <br />Commission, then she is in favor of lifting the moratorium and leaving the <br />Ordinance as it is currently. Mr. Montoya stated he is in favor of the <br />first process option on the Agenda Request Form. He would also like to <br />hold meetings with sign industry representatives or hold public hearings. <br />He stated he is not in favor of sending this back to the Planning and <br />Zoning Commission. Mr. Taylor stated he agrees with Ms. Narvaiz. He wants <br />the moratorium to expire. He stated some sign customers drafted a <br />proposed Ordinance for review and he would like Council to consider <br />looking at it and meeting with the sign customers. He also stated he is <br />not in favor of sending this Ordinance back to the Planning and Zoning <br />Commission. Mayor Habingreither stated he is in favor of lifting the <br />moratorium and to bring it back to the Council if the current Ordinance <br />does not work. He also stated he is in favor of meeting with sign <br />customers before ending of the moratorium. He feels the Council should <br />let Staff meet with the sign industry and come back with a recommendation. <br />Mr. Thomaides inquired how many applications are waiting for permits. Mr. <br />O'Leary stated there are 30 applicants requesting applications to put up <br />or change their billboards in San Marcos. He stated suddenly there was a <br />rush in applications, and this precipitated a discussion to make <br />restrictions to tighten up the current Ordinance. Mr. Mihalkanin stated <br />he is willing to modify the process options on the agenda request form to <br />provide for the holding of public hearings. He stated he feels Council <br />should not lift the moratorium, but Council and Staff should meet with the <br />sign customers. Mr. O'Leary stated he would set up a meeting and include <br />landowners and potential landowners who might weigh in on opportunity for <br />signs and sign customers.
