On roll <br />call the following vote was recorded: <br /> <br />AYE: <br /> <br />Narvaiz, Thomaides, Montoya, Taylor and Diaz. <br /> <br />NAY: None. <br /> <br />ABSTAIN: Mihalkanin and Habingreither (disclosure affidavits-business <br /> entity filed with City Clerk). <br /> <br />Mr. Taylor moved to reconsider Item 14 and Item 23, adoption of Resolution <br />adopted earlier on the consent agenda and Ms. Narvaiz seconded the motion, <br />which passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration Item 14, approval of an <br />Ordinance on second reading, the caption which reads as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 2, ADMINISTRATION, OF THE CITY CODE TO ADD A NEW <br />SECTION 2.045 ESTABLISHING RULES OF DECORUM FOR CITY COUNCIL <br />MEETINGS; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />Mr. Diaz moved for approval of the Ordinance on second reading and Ms. <br />Narvaiz seconded the motion. Ms. Narvaiz moved to amend Section 2.045 <br />Rules of Decorum (a) (1) to strike will and Mr. Taylor seconded the motion, <br />which passed unanimously. The Council then voted unanimously for approval <br />of the Ordinance on second reading. <br /> <br />Mayor Habingreither introduced for consideration Item 23, adoption of a <br />Resolution, the caption which reads as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN INTERLOCAL COOPERATION CONTRACT BETWEEN THE CITY AND THE <br />TEXAS DEPARTMENT OF PUBLIC SAFETY FOR IMPLEMENTATION OF THE ~FAILURE <br />TO APPEAR" PROGRAM DENYING DRIVER'S LICENSE RENEWAL FOR FAILURE TO <br />APPEAR IN MI3NICIPAL COURT; PROVIDING FOR THE CHARGING OF AN <br />ADMINISTRATIVE FEE; AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />CONTRACT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Narvaiz moved for adoption of the Resolution and Mr. Montoya seconded <br />motion. Mr. Taylor inquired whether the fees have changed to $4.00, and <br />is it worth collecting. Mr. O'Leary stated the City has 800 warrants <br />which have not been served. He stated this Resolution will allow the City <br />to contract with the Texas Department of Public Safety. He stated the <br />offender will not be able to renew his driver's license until Municipal <br />Court has been paid. The Council then voted unanimously for adoption of <br />the Resolution. <br /> <br /> <br />
