56. Regular Meeting May 12, 2003 Page 10 Ms. Narvaiz moved to table the Resolution until the next Regular Meeting to be held on May 28, 2003, and Mr. Taylor seconded the motion. On roll call the following vote was recorded: AYE: Narvaiz, Thomaides, Montoya, Taylor and Diaz. NAY: None. ABSTAIN: Mihalkanin and Habingreither (disclosure affidavits-business entity filed with City Clerk). Mr. Taylor moved to reconsider Item 14 and Item 23, adoption of Resolution adopted earlier on the consent agenda and Ms. Narvaiz seconded the motion, which passed unanimously. Mayor Habingreither introduced for consideration Item 14, approval of an Ordinance on second reading, the caption which reads as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING CHAPTER 2, ADMINISTRATION, OF THE CITY CODE TO ADD A NEW SECTION 2.045 ESTABLISHING RULES OF DECORUM FOR CITY COUNCIL MEETINGS; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Mr. Diaz moved for approval of the Ordinance on second reading and Ms. Narvaiz seconded the motion. Ms. Narvaiz moved to amend Section 2.045 Rules of Decorum (a) (1) to strike will and Mr. Taylor seconded the motion, which passed unanimously. The Council then voted unanimously for approval of the Ordinance on second reading. Mayor Habingreither introduced for consideration Item 23, adoption of a Resolution, the caption which reads as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AN INTERLOCAL COOPERATION CONTRACT BETWEEN THE CITY AND THE TEXAS DEPARTMENT OF PUBLIC SAFETY FOR IMPLEMENTATION OF THE ~FAILURE TO APPEAR" PROGRAM DENYING DRIVER'S LICENSE RENEWAL FOR FAILURE TO APPEAR IN MI3NICIPAL COURT; PROVIDING FOR THE CHARGING OF AN ADMINISTRATIVE FEE; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. Ms. Narvaiz moved for adoption of the Resolution and Mr. Montoya seconded motion. Mr. Taylor inquired whether the fees have changed to $4.00, and is it worth collecting. Mr. O'Leary stated the City has 800 warrants which have not been served. He stated this Resolution will allow the City to contract with the Texas Department of Public Safety. He stated the offender will not be able to renew his driver's license until Municipal Court has been paid. The Council then voted unanimously for adoption of the Resolution.
