65. Contract for Reevclin;~ Center and City Facilities Recycling Collection This Contract is made on Iqay 13, 2 0 0 3 between tile City of San Marcos, Texas (tile "City"), 630 East Hopkins, Sau Mareos, Texas 78666 and Green Guy Recycling Services, 937 Highway 80, San Marcos, TX 78666 (tbe "Contractor"), for the provision of recycling center and City facilities recycling collectiou services. The City and the Contractor agree as follows: ARTICLE 1 CONTRACTOR'S SERVICES AND RESPONSIBILITIES Section 1.1 Standards of Performance 1. I. I Tile Contractor is responsible for operation of a recycling drop-offceuter and collection of recyclable materials fi'om City facilities, and for the marketing and disposal of collected materials in accordauce with the terms and conditions of this Contract is a good and workmaulike manner. These services will include furnishing all labor, equipment, tools, materials, insurauce, supervision, and all other items necessary to complete the work as specified. No work under this Contract will be subcontracted by the Contractor without prior written approval from the City. Auy subcontracts will be in writing and will be subject to each provision of this Contract. 1.I.2 The Contractor certifies that it has fillly acquainted itself with all conditions related to this Contract and will complete its services in and under any conditions it may encounter or create, without additional cost to the City, except for material changes in conditions or requirements of the work occarring duriug the term of this Coutract without the fauIt of the Contractor. 1.1.3 Tile Coutractor certifies that it is not now nor will it become delinquent ill the paymeut of taxes to any governmental entity. Section 1.2 Definitions In this Contract, the following terms will have the followiug meanings: 1.2.1 Cart - A plastic contaiuer with attached lid and wheels. 1.2.2 Collection - The removal and transportation of materials fi'om tile pickup point to the approved processing or disposal site. 1.2.3 Director - Director of tile Department of Public Works or a person authorized to act tbr the Director. 1.2.4 Disposal site - A solid waste depository, including but not limited to sanitary landfills, trausfer stations, incinerators, aud waste processin~separation centers licensed, permitted or approved by all governmental bodies and ageucies having jurisdiction. i .2.5 Recyclable materials - Garage or rubbish material that still has useful physical or chemical properties after serving its original purpose and that call be reused or remanufactured into other products.
