1.5.3 Notifications aad Disposal Site Reports <br /> <br />The Contractor will forward, to the City at its reqnest, all copies of Texas Health Department Inspection <br />Reports for each recyclable materials processing facility and disposal site being used for the disposal of <br />recyclable materials collected under this Contract. <br /> <br />1.5.4 Interruption of Service <br /> <br />Notwitbstauding any other provision of this Contract, if an interruption in the Contractor's services continues <br />/'or a period often days, tbe City will bave tbe right to immediately terminate this Contract and to seek any <br />remedy provided by law. <br /> <br /> ARTICLE 2 <br />THE CITY'S RESPONSIBILITIES <br /> <br />Section 2.1 <br /> <br />The City will desiguate tbe Director to act as the City's authorized representative with respect to tbis <br />Contract. <br /> <br />Section 2.2 <br /> <br />The City will assist tile Contractor in encouraging customers and City employees to comply with regulations <br />by providing iustmction, public service contact, and informational materials. <br /> <br />Section 2.3 <br /> <br />The City will bear all costs incident to this Article. <br /> <br />ARTICLE 3 <br />PAYMENTS <br /> <br />Section 3.1 Rate and Payments <br /> <br />3.1.1 Tbe Contractor will bill the City for service rendered to residential units during a month within ten <br />calendar days following the end of the month, and tile City wilI pay the Contractor on or before the 30th day <br />following tbe date of eacb bill. Such billing aud payment will be based on the price rates and schedules set <br />forth iu subsection 3.1.3 of tbis Contract. <br /> <br />3.1.2 Tbe rate charged by tbe Contractor will be $.52 per month per residential unit, calculated iu <br />accordance with section 3.2 of this Contract. <br /> <br />Section 3.2 Calculation of Payments For Residential Units <br /> <br />3.2.1 Payment for each month's service will be determined by multiplying the contract rate in subsection <br />3.1.2 times 95% times the actual umnber of occupied residential dwelling units within the coutract area <br />during the immediately preceding month as shown by the City's utility billing records. <br /> <br />Page 5 <br /> <br /> <br />
