<br /> days. <br /> Motor vehicle means a motor vehicle that is subject to registration under the state <br /> Certificate of Title Act. <br /> Nuisance vehicle is a vehicle that is a public nuisance under section 34.194. <br /> Special interest vehicle means a motor vehicle of any age that has not been altered or <br /> modified from original manufacturer's specifications and, because of its historic significance, <br /> is being preserved by a hobbyist. <br /> Storage facility means a garage, parking lot or any type of facility or establishment <br /> for the servicing, repairing, storing or parking of motor vehicles. <br /> SECTION 4. Section 34.193 of the San Marcos City Code is amended as follows <br /> (underlining indicates added language; an overstrike indicates deleted language): <br /> Sec. 34.193. Penalties. <br /> (a) Any person who maintains, allows, causes or permits a nuisance vehicle on public <br /> or private property commits a misdemeanor and upon conviction shall be subject to a fine not <br /> to exceed $200.00. Each day a violation continues constitutes a separate offense. <br /> (b) Upon conviction, the court shaH may order the removal and abatement of the <br /> nuisance vehicle, if it has not been previously abated. <br /> SECTION 5. Section 34.196 of the San Marcos City Code is amended as follows <br /> (underlining indicates added language; an overstrike indicates deleted language): <br /> Sec. 34.196. Nuisance vehicles prohibited on private property. <br /> ( a) It is unlawful for the ow ner of a person that owns or controls any real property to <br /> maintain. allow. cause or permit a nuisance vehicle to be placed or to remain on the property. <br /> (b) It is unlawful for a person to maintain. allow. cause or permit a nuisance vehicle <br /> to be placed or to remain on real property without the permission of the owner of the <br /> property. <br /> SECTION 6. If any word, phrase, clause, sentence, or paragraph of this ordinance <br /> is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br /> provisions of this ordinance will continue in force if they can be given effect without the <br /> invalid portion. <br /> SECTION 7. All ordinances and resolutions or parts of ordinances or resolutions in <br /> conflict with this ordinance are repealed. <br /> SECTION 8. Any person violating any provision of this ordinance commits a <br /> misdemeanor and upon conviction is subject to the penalties provided in Sections 34.080, <br /> 34.081,34.193,34.200 and 1.015 of the San Marcos City Code, as applicable. <br /> SECTION 9. This Ordinance takes effect ten (10) days after the date of its final <br /> passage, and the City Secretary will publish notice of its adoption in a newspaper of general <br /> circulation in the City. <br /> PASSED AND APPROVED on first reading SEPTEMBER 28, 1998. <br /> PASSED AND APPROVED on second reading OCTOBER 12, 1998. <br />
