<br /> In this subsection, covered multifamilydwellinas means buildings consisting of four <br /> (4) or more units if the buildings have one or more elevators, and ground floor units <br /> in other ~ings consisting of four (4) or more units. <br /> (5) Making an inquiry to determine whether an applicant for a dwelling, a person <br /> intendina to reside in that dwellina or any person associated with that person, has <br /> a disability or to determine the nature or severity of any disability, except that the <br /> followina inquiries may be made if these inquiries are made of all applicants, <br /> reaardless of disability: <br /> (A) Inquiry into an applicant's ability to meet the requirements of ownership <br /> or tenancy; <br /> <br /> (B) Inquiry to determine whether an applicant is qualified for a dwelling <br /> available only to persons with disabilities or to persons with a particular type <br /> of disability; <br /> <br /> (C) Inquiry to determine whether an applicant for a dwelling is qualified for <br /> a priority available to persons with disabilities or to persons with a particular <br /> type of disability; <br /> <br /> (D) Inquiring whether an applicant for a dwellina is a current illeaal user or <br /> addict or a controlled substance: or <br /> <br /> (E) Inquiring whether an applicant has been convicted of the iIIeaal <br /> manufacture or distribution of a controlled substance, <br /> (d) Compliance with the appropriate requirements of the American National <br /> Standard for buildinas and facilities providina accessibility and usability for persons with <br /> Q.hysica~ities, commonlY cited~ 7,1," suffices to satisfy the requirements <br /> of subsection (c)(4)(C) of this section. <br /> (e) Nothing in this subsection requires that a dwellina be made available to an <br /> individual whose tenancy would constitute a direct threat to the health or safety of other <br /> individuals or result in substantial physical damage to the property of others. <br /> Sec. 46.077. Exemptions and exclusions to section 46.976. <br /> (a) This subsection shall be excluded and/or exempted from the application of <br /> section 46.076. exemptions and/or ~clusions of the application of section 46.076 shall be <br /> only for the foIlO'ft'ing: <br /> (1) Any single..family dwelling sold or rented by its o'iW'ler, pro'~'ided that: <br /> a. The indi',¡idual o'wner does not o'wn mor-e than three single family <br /> <br /> dwellings 'y.,,¡thirt the city or it3 extraterritorial jurisdiction at arty one <br /> time'; <br /> b. The exemption granted by this subsection shall apply only '{v'ith respect <br /> <br /> to one sale 'v"t'ithin any 24 month period, and only if the sale of the <br /> single-family dwelling is by it'S private indi'fidual O'~vner; <br /> c. The bona fide private individual OVfller does not OVv'fl any interest nor <br /> <br /> is any inter-est O'imed or reserved on the O"¡v'fler's behalf, under arty <br /> expr-ess or voluntary agreemertt, or title to or any right to all Of a <br /> portion of the proceeds from the sale or rental of mor-e than three <br /> single-family dv~'8l1ings at anyone time; <br /> 10 <br />
