<br /> d. The sale or rental of any single family d'vvelling shall be excepted from <br /> the application of this article only if the d"Nelling is sold or rented <br /> without: <br /> 1. The use in any manner of the sales or rental facilities or the <br /> <br /> sales or rental services of any real estate broker, agent or <br /> salesman or of the facilities or services of any person in the <br /> business of selling or renting dvlellings or of any employee or <br /> agent of any broker, agent, salesman or person; and <br /> 2. The publication, posting or mailing of any advertisement or <br /> <br /> ,¡witten notice in violation of subsection 46.076(c), but nothing <br /> in this subsection shall prohibit the use of attorneys, escrow <br /> agents, abstractors, title companies and other types of <br /> professional assistance as necessary" to perfect or transfer the <br /> titfe-: <br /> (2) The rental of rooms or units in dwellings containing Ih¡ing quarters occupied <br /> or intended to be occupied by no more than four families living independently <br /> of each other, if one set of living quarters is maintained and occupied as <br /> residency by and for the owner. <br /> (b) Nothing in this article shall prohibit a religious organization, association or society <br /> or a nonprofit institution or organiZ'ation operated, supervised or controlled by or in <br /> conjunction'ý""ith a religious organization, association or society from limiting the sale, rental <br /> or occupancy of d\vellings which it o¥~s or operates for other than a commercial purpose <br /> to persons of the same religion or from gi'v'ing preference to any persons, unless <br /> membership in their religion is restricted because of sex, race, color or national origin. <br /> (c) Nothing in this article shall prohibit a private club not in fact open to the public, <br /> 'ihlich as an incident to its primary purpose pro'v'ides lodgings vlhich it O.i1RlS or operates for <br /> other than a commercial purpose, from limiting the rental or occupancy of lodgings to its <br /> members. <br /> Sec. 46.082. Certain sales and rentals exempted, <br /> (a) Subject to subsection (b) of this section. sections 46.076 through 46.081 and <br /> sections 46.087-46.089 of this article do not apply to: <br /> (1) The sale or rental of a single-family house sold or rented by an owner if: <br /> ( a) the owner does not: <br /> <br /> 0) own more than three (3) sinqle-family houses at anyone time: or <br /> <br /> (ij) own any interest in. nor is there owned or reserved on the person's <br /> behalf. under any express or voluntary agreement. title to or any right <br /> to any part of the proceeds from the sale or rental of more than three <br /> single-family houses at anyone time: and <br /> <br /> (b) the house is sold or rented without: <br /> <br /> (i) the use of the sales or rental facilities or services of a real estate <br /> broker. agent. or salesman licensed under the state Real Estate <br /> License Act. as amended. or of an employee or agent of a licensed <br /> broker. agent or salesman. or the facilities or services of the owner of <br /> a dwelling designed or intended for occupancy by five or more <br /> families: or <br /> <br /> 11 <br />
