<br /> (ii) the publication, postinQ or mailing of a notice, statement or <br /> advertisement prohibited by section 46.078: or <br /> (2) The sale or rental of rooms or units in a dwellinQ containinQ livinQ Quarters <br /> occupied by or intended to be occupied by no more than four families livinQ <br /> independently of each other if the owner maintains and occupies one of the livinQ <br /> Quarters as the owner's residence. <br /> (b) The exemption contained in subsection (a) (1) applies only to one sale or rental <br /> of a 24-month period if the owner did not reside in the house at the time of sale or rental <br /> or was not the most recent resident of the house prior to the sale or rental. <br /> Sec. 46.083. Reliaious oraanization and private club exemption. <br /> (a) This article does not prohibit a reliQious orQanization. association, or society or <br /> a nonprofit institution or organization operated. supervised, or controlled by or in <br /> conjunction with a reliQious orQanization, association. or society, from: <br /> (1) limitinQ the sale. rental. or occupancy of dwellings that it owns or operates for <br /> other than a commercial purpose to persons of the same reliQion: or <br /> (2) giving preference for such dwellings to persons of the same religion, un~ <br /> membership in the religion is restricted because of race, color. or national origin. <br /> (b) This article does not prohibit a private club that is not open to the puQJ;c anq <br /> that. as an incident to its primary purpose. provides 10dQing that it owns or operates for <br /> other than a commercial purpose from limitinQ the rental or occupancy of that 10dginQ to its <br /> members or from aivina preference to its members. <br /> Sec. 46.084. Appraisals. <br /> This article does not prohibit a person enQaged in the business of furnishing <br /> appraisals of residential real property from taking into consideration factors other than race. <br /> color, reliQion. sex. disability. familial status. or national origin. <br /> Sec. 46.085. Housing for elderly exempted. <br /> The provisions of this article relating to familial status do not apply to housing for <br /> elderly persons. <br /> Sec. 46.086. Effect on other law. <br /> (a) This article does not affect a reasonab~ or state restriction on the <br /> maximum number of occupants permitted to occupy a dwellina or a restriction relatinQ to <br /> health or safety standards. <br /> (b) This article qoes not affect a reauiremenLQf nonqiscrimination in any o~ <br /> ordinance or state or federal law. <br /> Sec. 46.078.
