<br />45. <br /> <br /> <br />LEASE AGREEMENT <br /> <br /> <br />STATE OF TEXAS <br /> <br />COUNTY OF HAYS <br /> <br />This Lease Agreement ("Lease") is made this 22nd day of December , <br />199~, between the City of San Marcos, Texas, a Texas municipal corporation ("Lessor") and <br />Greater San Marcos Area Seniors Association, Inc., a Texas not-for-profit corporation <br />("Lessee"). <br /> <br /> <br />RECITALS: <br /> <br />I. The Lessor is the owner of the property at 222 West San Antonio Street in San Marcos, <br />Hays County, Texas (the "Property"), the legal description of which is Lot Nos. 3 and 4, <br />Block 15 of the Original Town of San Marcos, according to the map or plat thereof <br />recorded in Volume 46, page 448 of the Deed Records of Hays County, Texas. <br /> <br />2. The Lessor's governing body accepted the donation of the Property "for the purpose of <br />providing the City of San Marcos with a facility to be used for youth and/or senior citizen <br />activity programs" in a deed from the First Christian Church recorded in Volume 994, <br />page 684 of the Hays County Deed Records. <br /> <br />3. The Lessee submitted a proposal to lease the Property from the Lessor for the purposes <br />stated above. <br /> <br />4. The Lessor's governing body wishes to accept the proposal submitted by the Lessee, and <br />the Lessor and Lessee agree to the lease of the Property in accordance with the terms of <br />this Lease Agreement. <br /> <br />WITNESSETH: <br /> <br />The Lessor, for and in consideration of the Lessee's payment of rentals and performance <br />of the covenants and agreements contained in this Lease, and for the further consideration <br />of the renovation by the Lessee ofthe existing facilities on the Property, and the Lessee's <br />fulfillment of the goals and purposes described in this lease, has demised, leased, and let <br />the Property to the Lessee under the following terms and conditions. <br /> <br />1. Term: The term of this Lease is thirty (30) years commencing on January 1, 1999, and <br />ending on December 31, 2028. <br /> <br />2. Rental: The Lessee covenants and agrees to pay to the Lessor as rent for the Premises the <br />sum of $1.00 per year, due and payable on or before each anniversary date of this Lease. <br />
