<br /> 3. Purposes: The Property shall be used by the Lessee for youth and/or senior citizen <br /> activity programs for the San Marcos Community. <br /> 4. Structures and Improvements: <br /> <br /> A. The Lessee has performed, or has been given the opportunity to perform, all <br /> inspections and testing of the Property necessary for the Lessee to determine its <br /> present condition, its suitability for renovation, and its suitability for the purposes <br /> stated in Paragraph 3 above. The Lessee, as an essential element of the <br /> consideration given by it for this lease, accepts the Property in its present <br /> condition, with all faults, and without any warranty by the Lessor as to its <br /> condition or its suitability for any purposes. <br /> B. The Lessee shall begin renovation activities in a reasonably timely manner <br /> following execution of this Lease, and the Lessee shall cause the renovation of the <br /> building and improvements on the Property with a value of at least $30,000 during <br /> the first five (5) years of the Lease, and an average of$10,000 per year during the <br /> next ten (10) years of the Lease, in terms of monetary outlays and/or in-kind <br /> contributions, volunteer services and labor. Any value of the renovation in excess <br /> of the $30,000 amount for the first five (5) years will be carried over to satisfy the <br /> Lessee's obligations during the succeeding ten (10) years ofthe Lease. <br /> The Lessee agrees not to use all or any portion of this building for public <br /> purposes, including meetings of the Lessee's governing body or members before <br /> the Lessor issues a certificate of occupancy for the building or portion to be <br /> occupied, but the Lessee may perform general housekeeping, inspections and <br /> activities related to renovation. <br /> C. The Lessee shall have the right to construct additional structures on the Property <br /> for the provision of its programs. Each structure shall be constructed and shall <br /> remain in compliance with all ordinances, rules and regulations of the Lessor. <br /> D. All alternations, additions, and improvements to the Property and all structures <br /> and buildings constructed or placed on it, except for non-fixtures, such as <br /> refrigerators, ranges, ovens, pianos and the like, shall become property of the <br /> Lessor upon any termination of this Lease and shall remain and be surrendered <br /> with the Property, unless otherwise provided in writing by the parties. The Lessee <br /> waives all claims for damages to or loss of any property belonging to the Lessee <br /> that remains on the property (except for a reasonable removal period) after any <br /> termination of this Lease. <br /> 5. Water, Sewer and Electricitv: The Lessee agrees to pay all charges for water, sewer and <br /> electric services used in and on the Property in accordance with the Lessor's rates for <br /> these services, as and when the Lessor's bills are rendered.
