<br /> agrees that at no time shall its use of electric current exceed the capacity of the wiring <br /> system located on the Property. The Lessee shall ensure that the electrical installation and <br /> wiring meet applicable state and local laws, ordinances, regulations and standards and <br /> that electric outlets are properly spaced to afford maximum safe use of the Property. <br /> 6. Utilities: The Lessee shall furnish all utilities of every type and nature not otherwise <br /> expressly provided for in this Lease at its own expense. The Lessee shall payor cause to <br /> be paid when due, all bills for all other utilities used on, in connection with or chargeable <br /> against the Property until the expiration of this Lease and surrender of the Property by the <br /> Lessee. <br /> 7. Repairs and Maintenance.: The Lessee agrees to maintain the Property, the grounds, and <br /> all structures and improvements constructed or placed on them clean, safe and in good <br /> order and condition at all times. The Lessee shall make all repairs to the Property and <br /> improvements on the Property necessary during the term of this Lease, including all <br /> structural repairs, at its own cost and expense. The Lessee may request the in-kind <br /> assistance of the Lessor for extraordinary maintenance such as tree trimming. The Lessee <br /> shall deliver up the Property and any structures and improvements constructed or placed <br /> on it in good order and condition, reasonable wear and tear excepted, at the expiration or <br /> upon any termination of this Lease. The Lessee shall keep the Property free from all <br /> refuse and obstructions. The Lessee shall arrange for the prompt removal of all garbage <br /> and refuse of any kind from the Property. <br /> 8. Fees: The Lessor agrees to waive all construction-related fees, other than impact fees, as <br /> defined in Sections 86.291 and 86.331 of the City Code, it may lawfully collect from the <br /> Lessee as to improvements on the Property. <br /> 9. Casualty Insurance. Rebuilding and Repair of Damage to Structure: <br /> <br /> A. The Lessor agrees to keep and maintain in effect, fire insurance with extended <br /> coverage, and general casualty insurance, in a sum not less than the replacement <br /> value of all improvements on the Property. The Lessee may, at its option, carry <br /> casualty insurance coverage on its personal property on the premises. <br /> B. In the event that any structure or improvement on the Property is damaged or <br /> destroyed by casualty, fire or otherwise, to an extent which renders the Property <br /> unfit for the Lessee's purposes, as the Lessee may determine, the Lessee may <br /> terminate this Lease. <br /> C. In the event of a termination of this Lease as described in B above, Lessee is <br /> granted the first right of refusal to negotiate a new lease with Lessor for a <br /> reconstructed structure on the Property. <br /> 10. Sidewalks. Parking Areas. Yards and Landscaped Areas: The Lessee shall keep all <br /> sidewalks and parking areas on the Property in good condition and repair and shall <br />
