<br /> 21. Compliance With Laws: The Lessee agrees to 'comply with all laws, ordinances, rules <br /> and regulations which may pertain or apply to the Property, the construction of any <br /> structure or improvement on the Property, or the Lessee's use of the Property. <br /> 22. Notices: All notices required to be given to Lessor hereunder shall be given by certified <br /> mail, return receipt requested, addressed to the City Manager, City of San Marcos, 630 <br /> East Hopkins, San Marcos, 78666. All notices required to be given to the Lessee <br /> hereunder shall be given by certified mail, return receipt requested, addressed to the <br /> President, Greater San Marcos Area Seniors Association, 510 West Hopkins, San <br /> Marcos, TX. 78666. The parties will notify each other in writing of any change in their <br /> address for notice purposes. <br /> 23. Severability: In the event any covenant, phrase, clause, paragraph, section, condition or <br /> provision of this Lease is held to be invalid by any court of competent jurisdiction, the <br /> invalidity of the covenant, phrase, clause, paragraph, section, condition or provision shall <br /> not affect any other covenant, phrase, clause, paragraph, section, condition or provision of <br /> this Lease. <br /> 24. Descriptive Headings For Convenience Only: he descriptive headings appearing in this <br /> Lease are for convenience only, and are not to be construed either as a part of he terms <br /> and conditions, or as any interpretation, of this Lease. <br /> 25. Amendment Or Modification: Both parties acknowledge and agree that this Lease shall <br /> be valid or binding unless expressed in writing and executed by the parties in the same <br /> manner as the execution of this Lease. <br /> 26. Lessor Rights of Use and Inspection: <br /> <br /> A. The Lessor shall have the right to use and occupy the Property, with the prior consent <br /> of the Lessee, at times when the Property is not in use by the Lessee. <br /> B. Upon reasonable prior notice to Lessee, the Lessor may enter upon and inspect the <br /> Property in the presence of a representative of the Lessee to ascertain whether the <br /> Property is being properly maintained and kept in repair and good order by Lessee in <br /> accordance with the Lease. In the event of an emergency, however, the Lessor may <br /> enter upon and inspect the Property without providing prior notice to the Lessee. <br /> 27. Nondiscrimination: The Lessee agrees not to discriminate on the basis of race, creed, <br /> color, religion, sex, national origin or physical disability in its activities or programs <br /> associated with the Property. <br /> 28. Governing Law: Venue: This Lease will be governed by the laws of the state of Texas. <br /> Exclusive venue for any legal action under this Lease is in Hays County, Texas. <br /> - <br />
