<br />49. <br /> <br /> <br /> <br /> <br />RESOLUTION 1998- .2lúLR <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF A REVISED <br />AGREEMENT BETWEEN THE CITY AND HAYS COUNTY, THE HAYS <br />COUNTY APPRAISAL DISTRICT, THE SAN MARCOS CONSOLIDATED <br />INDEPENDENT SCHOOL DISTRICT, SOUTHWEST TEXAS STATE <br />UNIVERSITY, AND THE SOUTHWEST TEXAS STATE UNIVERSITY <br />SUPPORT FOUNDATION FOR SETTLEMENT OF PROPERTY TAX <br />ISSUES REGARDING THE AQUARENA SPRINGS AND FIRE STATION <br />STUDIOS PROPERTIES; AUTHORIZING THE MAYOR PRO-TEM TO <br />EXECUTE THE AGREEMENT ON BEHALF OF THE CITY; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. A dispute exists between local taxing entities and Southwest Texas State <br />University (SWT) and the SWT Support Foundation (the Foundation) regarding property <br />taxes owed on, and the taxable status of, the former Aquarena Springs properties now <br />owned by SWT and the Fire Station Studios owned by the Foundation. <br /> <br />2. The City, Hays County, the Hays County Appraisal District (HCAD) and the San <br />Marcos Cånsolidated Independent School District (SMCISD) have reached agreement with <br />SWT and the Foundation to resolve this dispute. <br /> <br />3. The city Council approved a settlement agreement regarding this dispUte on <br />November 9, 1998. <br /> <br />4. The HCAD and SWT have negotiated revisions to the settlement agreement, <br />and it is necessary for the City Council to approve the agreement with those changes. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The terms and conditions of the Agreement attached to this Resolution <br />between the City and Hays County, the Hays County Appraisal District, SMCISD, SWT and <br />the Foundation for settlement of property tax issues regarding the Aquarena Springs and <br />Fire Station Studios properties are approved. <br /> <br />PART 2. The Mayor Pro-Tem, Joe B. Cox, Jr., is authorized to execute this <br />Agreement on behalf of the City. <br /> <br />PART 3.
