<br /> 50 <br /> AGREEMENT <br /> The County of Hd's, the San Marcos Consolidated Ind(p.endent School District, the City of San Marcos <br /> ,~"Taxing Authorities") an the Ht;s County 'Ítpraisal District 'District") AND Southwest Texas State University <br /> ( 'Universi~') and the Southwest exas State niversity Foundation ("Foundation"), desiring to end disputes between <br /> them, whic are presently pending respective of the Umversity's Aquarena Springs properties and the Foundation's Fire <br /> Station Studio property, stIpulate and agree as follows: <br /> 1. The University will make payment to the below named entities in the following sums in settlement of <br /> such pending disputes: <br /> City $ 31,130.02 <br /> H~s County 31,130.02 <br /> S CISD ~ <br /> 200,439.61 <br /> 2. The Taxing Authorities forever release the Universit)' and the Foundation from an~ property tax, <br /> penalty) interest, attorney's fees, or other collection of fee amounts currently due e Taxinã <br /> Authonties for the period since the properties were acquired by the University or the Foun ation to <br /> the date of this Agreement. <br /> 3. The property remaining at issue (the Inn at Aquarena Springs) is and shall be regarded by the Taxing <br /> Auiliorities and the District as tax exempt for the uses to wlÜch the property is currently put. <br /> 4. Regarding the restaurant property now known as Joe's Crab Shack, the District and the Taxing <br /> Authorities agree to send tax appraisals and statements to the property's lessee. <br /> 5. This Agfeement is not an admission of tax liabili~ on the part of either the University or the <br /> Foundation but rather is a resolution of disputed c aims and an effort by the Universip't and the <br /> Foundation to buy their peace and to assure tranquility in the community. The fact 0 this Agreement, <br /> resolution, and payment shall not be used by either party against the other in any future dispute, <br /> litigation, or proceeding of whatever kind. <br /> 6. This constitutes the entire agreement between the parties; and, all negotiations, understandings, <br /> resolutions, and agreements are subsumed herein.
