<br /> 56 <br /> - <br /> RESOLUTION 1997 - 9 R <br /> I <br /> A RESOLUTION OF THE CITY COUNCIL OF <br /> THE CITY OF SAN MARCOS, TEXAS <br />-- APPROVING THE TERMS AND CONDITIONS <br /> OF AMENDMENTS NO.1 AND NO.4 TO THE <br /> LEASE OF AIRPORT PROPERTY BETWEEN <br /> SOUTHWEST TEXAS AVIATION, INC. AND <br /> THE CITY; AUTHORIZING THE CITY <br /> MANAGER TO EXECUTE THE AMENDMENTS; <br /> AND DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. On March 28, 1995 the City entered into an agreement with Southwest Texas <br />Aviation, Inc. ("SWT A"), concerning the construction of a new hangar on the San Marcos <br />Municipal Airport under which the lease term was not to begin until SWT A moved into the <br />hangar. , <br />2. SWT A occupied the new hangar on October 15, 1996 and Amendment No.1 <br />changes the term of the original lease to reflect this beginning date. <br />3. The City executed a lease with James W. Miller d/b/a Miller Air Sports on January <br />27, 1981 for a separate hangar on the Airport, which was assigned to SWT A on May 29, <br />1986. Amendment No.4 to this lease changes the term of the lease to coincide with the <br />lease for the new hangar and to realign the rental payments to coincide with the rental <br />payments of the new hangar. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> PART 1. The attached Amendments No.1 and No.4 to the above leases are <br />approved. <br /> PART 2. The City Manager, Larry D. Gilley, is authorized to execute the <br />amendments. <br /> PART 3.
