84. Regular Meeting May 28, 2003 Page 4 Ms. Narvaiz moved for approval of the Ordinance on first reading and Mr. Taylor seconded the motion. Mr. O'Leary stated these amendments will change the Level One Violations to $20.00, Level Two Violations to $30.00, Level Three Violations to %50.00 and Level Four Violations to $250.00. Johnny James, Interim Police Chief, stated the increase immobilization (boot) fee increased from $25.00 to $50.00. Mr. Thomaides inquired whether the Downtown merchants participated in these amendments. Mr. O'Leary stated he spoke with the Downtown merchants regarding raising the fees. The Downtown merchants did approve the raising of parking fees to $20.00. The Council then voted unanimously for approval of the Ordinance on first reading. Ms. Narvaiz introduced for consideration adoption of an Ordinance on third and final reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE ABANDONMENT OF FOUR UNOPENED ALLEYS IN THE PARK ADDITION NEAR THE 100 AND 200 BLOCKS OF SESSOM DRIVE; APPROVING THE CONVEYANCE OF THESE ALLEYS TO SOUTHWEST TEXAS STATE UNIVERSITY; AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED; AND INCLUDING PROCEDURAL PROVISIONS. Mr. Diaz moved for adoption of the Ordinance on third and final reading and Mr. Taylor seconded the motion. On roll call the following vote was recorded: AYE: Narvaiz, Thomaides, Taylor and Diaz. NAY: None. ABSTAIN: Mihalkanin and Habingreither (disclosure affidavits-business entity filed with City Clerk). Ms. Narvaiz introduced for consideration removal from table and adoption of an Ordinance on third and final reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING THE ABANDONMENT OF THE 500 BLOCK OF NORTH FREDERICKSBURG STREET; APPROVING THE CONVEYANCE OF THIS TRACT TO SOUTHWEST TEXAS STATE UNIVERISITY AND AMERICAN CAMPUS (SWT II) LTD.; AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED; AND DECLARING AN EFFECTIVE DATE. Mr. Thomaides moved to remove the Ordinance from the table and Mr. Taylor seconded the motion. On roll call the following vote was recorded: AYE: Narvaiz, Thomaides, Taylor and Diaz. NAY: None.
