<br />Sec 90.301. Definitions <br /> <br />In this article: <br /> <br />Shuttle means every motor-propelled vehicle or trailer, of any type or size, used for the <br />transportation for hire of individuals or water oriented recreational equipment for the <br />purpose of transporting such individuals or water oriented recreational equipment in <br />connection with tubing, kayaking, rafting, or similar water recreation activities upon <br />rivers and streams that flow within the city limits of the City or San Marcos. A vehicle <br />shall be deemed to be a "shuttle vehicle" whether or not the vehicle operates on a <br />regular fixed route within the city and whether or not the business operating the vehicle <br />is principally located within the city limits or without the city limits, so long as the vehicle <br />is operating on the public streets of the city. <br /> <br />Water oriented recreational equipment means tubes, kayaks, rafts, canoes and all other <br />forms of personal watercraft. <br /> <br />Sec. 90.302 Vehicle inspection and maintenance. <br /> <br />(a). All shuttles operated pursuant to this article shall be inspected as required by <br />state law and shall be maintained in a safe and sanitary operating condition at all times. <br /> <br />Sec. 90.303. Restrictions on operation <br /> <br />(a). The routes to be used by shuttles, including stops to let off or pick up persons, <br />are subject to the prior written approval of the City Manager or the Manager's designee. <br /> <br />(b). No shuttle may pick up and discharge passengers or equipment by stopping on a <br />city street, except stops designated in an approved route. <br /> <br />(c). Shuttles will be restricted to their respective, approved routes. <br /> <br />(d) Shuttles shall only be operated during the dates and times designated on their <br />franchise. <br /> <br />(e) All shuttles that carry passengers will be equipped with seating for each <br />passenger carried. All persons carried by a shuttle operated on streets within the city <br />limits must be seated. <br /> <br />(t). All operators of a shuttle must be at least 18 years of age. <br /> <br />Sec 90.304. Criminal penalty for violation of article. <br /> <br />(a). Any person, agent, or business who shall knowingly, intentionally or recklessly <br />violate a provision of this article or who fails to comply therewith shall be deemed guilty <br />of a misdemeanor.
