<br />each and every day or portion thereof during which any violation of the provisions of this <br />article is committed or continued, and upon conviction in the court of jurisdiction for any <br />such violation, such person shall be punished in accordance with Section 1.015 of the <br />San Marcos City Code. <br /> <br />(b). It shall be an offense to allow the occupancy of more persons in a shuttle than the <br />number of seats in a shuttle that is operated within the city limits of the City of San <br />Marcos. <br />(i) The owner of the franchised business, as well as the driver of the shuttle, will <br />be responsible for compliance with this provision. <br />(ii) A person found violating this provision shall be punished by a fine of not less <br />than $300.00 nor more than $500.00. <br />(iii) A business whose owner or employees have been found guilty of violating <br />this provision three or more times in any given franchise year will have its franchise <br />forfeited for a minimum of three years. <br /> <br />(c) Authority to enforce this article is vested in the San Marcos Police, the San Marcos <br />Park Rangers, and the San Marcos Marshals. <br /> <br />Secs. 90.305-90.309. Reserved. <br /> <br />Division 2. FRANCHISE <br /> <br />Sec. 90.310. Franchise Required and Application. <br /> <br />(a) It shall be unlawful to operate a shuttle vehicle within the city limits without having <br />obtained a franchise from the city. No shuttle franchise shall be issued until the owner <br />or person in charge or control of such shuttle shall make a written application, pay the <br />required franchise fee described in this section, meet the required safety standards, <br />obtain the required insurance, and submit the following required information: <br /> <br />(1) Name of owner or person by whom such franchise is desired; <br /> <br />(2) Business address; <br /> <br />(3) Type of vehicle or vehicles to be operated by the Franchisee (e.g. trailer, <br />truck, bus, etc) and State of Texas license plate number. <br /> <br />(4) Name of registered titleholder of each vehicle or trailer if not registered in <br />the name of the Franchises; <br /> <br />(5) The seating capacity for each vehicle that carries passengers; <br /> <br />(6) A maps detailing the proposed route(s); <br /> <br />(7) The dates of operation for the business; <br />
