each and every day or portion thereof during which any violation of the provisions of this article is committed or continued, and upon conviction in the court of jurisdiction for any such violation, such person shall be punished in accordance with Section 1.015 of the San Marcos City Code. (b). It shall be an offense to allow the occupancy of more persons in a shuttle than the number of seats in a shuttle that is operated within the city limits of the City of San Marcos. (i) The owner of the franchised business, as well as the driver of the shuttle, will be responsible for compliance with this provision. (ii) A person found violating this provision shall be punished by a fine of not less than $300.00 nor more than $500.00. (iii) A business whose owner or employees have been found guilty of violating this provision three or more times in any given franchise year will have its franchise forfeited for a minimum of three years. (c) Authority to enforce this article is vested in the San Marcos Police, the San Marcos Park Rangers, and the San Marcos Marshals. Secs. 90.305-90.309. Reserved. Division 2. FRANCHISE Sec. 90.310. Franchise Required and Application. (a) It shall be unlawful to operate a shuttle vehicle within the city limits without having obtained a franchise from the city. No shuttle franchise shall be issued until the owner or person in charge or control of such shuttle shall make a written application, pay the required franchise fee described in this section, meet the required safety standards, obtain the required insurance, and submit the following required information: (1) Name of owner or person by whom such franchise is desired; (2) Business address; (3) Type of vehicle or vehicles to be operated by the Franchisee (e.g. trailer, truck, bus, etc) and State of Texas license plate number. (4) Name of registered titleholder of each vehicle or trailer if not registered in the name of the Franchises; (5) The seating capacity for each vehicle that carries passengers; (6) A maps detailing the proposed route(s); (7) The dates of operation for the business;
