<br />(8) The number and location of off street parking spaces as required in <br />Section 90.311, of this article, if applicable; <br /> <br />(9) A statement of gross revenue received from river related activities for the <br />previous year; and, <br /> <br />(10) A comprehensive description of the type and nature of business being <br />conducted on the San Marcos River, including a listing of the types of <br />water oriented recreational equipment being transported by the <br />franchisee. <br /> <br />(b). The franchise described in this section is not a limousine or taxicab license as <br />described in articles 2 and 3 of this chapter, and the holder of a shuttle vehicle franchise <br />shall not be considered a licensed taxicab, and shall not have the rights and privileges <br />and obligations as described in articles 2 and 3 of this chapter. Any vehicle previously <br />licensed or hereafter licensed as a taxicab under article 3 of this chapter shall not be <br />deemed to have a shuttle vehicle franchise under the provisions of this article unless <br />separate application is made and a separate franchises obtained under this article. <br /> <br />(c). Franchises issued under this article are permanent franchises issued to the <br />individual business solely for the purposes set forth in their original application. All <br />franchisees shall be subject to an annual fee. The annual fee will be due on or before <br />the date set forth in the franchise. All franchisees must submit a statement of gross <br />revenue for the previous franchise year concurrently with the submission of the <br />appropriate yearly franchise fee. <br /> <br />Sec. 90.311. Appeal of Denial of Franchise and Suspension and Revocation of <br />Franchise <br /> <br />(a) Any person or firm denied a franchise under this Article may appeal such denial to <br />the City Manager. Should the City Manager affirm the denial, the person may appeal to <br />the City Council who will have final authority over the franchise process. <br /> <br />(b) A franchise issued under this division may be revoked or suspended by the <br />municipal court judge for any of the following reasons: <br /> <br />(1) The holder or any agent or employee of this the holder has violated any <br />sections of this article; <br />(2) The holder has violated any part of 9 90.304 of this Article three times in a <br />calendar year. <br />(3) The holder has violated any ordinances of the city or law of the United <br />States or the state, the violation of which adversely affects the ability of the <br />holder to either offer public transportation or do so in a safe manner. <br />
