<br />(c) The chief of police, or the supervisor of the park rangers, may present a petition <br />to the municipal court for suspension or revocation stating the reasons for the proposed <br />action. The holder shall be provided with a copy of the petition and shall have an <br />opportunity to be heard by the municipal court judge prior to the judge's decision. <br /> <br />Sec. 90.312. Off street parking. <br /> <br />All persons or entities operating a river shuttle must provide sufficient off street parking <br />for users of the shuttle. <br /> <br />(a) Sufficient parking shall be the greater of: <br /> <br />(1) The number of spaces previously required of the business under the San <br />Marcos Land Development Code; <br /> <br />(2) One off street parking space for every two persons of capacity based on <br />the number of shuttles franchised and the capacity of each shuttle vehicle. <br /> <br />(3) If operating a business that rents water oriented recreational equipment, or: <br /> <br />(i) One off street parking space for every 100 square feet of building, or; <br /> <br />(ii) One off street parking space for every four pieces of water oriented <br />recreational equipment. This number will be based on the number of <br />tubes that could be fit into the cubic feet of storage areas available to the <br />business. <br /> <br />Sec. 90.313 Fees. <br /> <br />A franchise fee shall be charged based on the gross revenues of the business for <br />the previous operational year. For new franchisees, without local business experience, <br />the initial fee shall be the maximum fee charged on the schedule. The franchise fee <br />shall be set by separate resolution of the City Council. The annual franchise shall be <br />valid from May 1 through April 30 of each year issued. The initial franchise year shall be <br />considered to run from the date the franchise is issued through the next April 30th . <br />There shall be no prorating of the franchise fee. <br /> <br />Sec. 90.314. Insurance Required. <br /> <br />Franchisee will maintain in full force and effect insurance against liability arising out of <br />injury or death to any person or property damage caused by the negligent or willful <br />misconduct of the Franchisee's servants, agents or employees or by the unsafe <br />condition or operation of its trailers or any motor vehicles pulling the trailers, and this <br />insurance shall be in a minimum amount of one hundred thousand dollars <br />($100,000.00) for anyone person. and three hundred thousand dollars ($300,000.00) <br />
