<br />for each single occurrence of bodily injury or death: and one hundred thousand dollars <br />($100,000.00) for any single occurrence of injury to or destruction of property: and such <br />insurance policy will contain an endorsement that such insurance may not be canceled <br />or amended with respect to the Franchisee without ten (10) days prior written notice, by <br />registered mail, to the City by the insurance company. The original policy of all such <br />insurance will be delivered by the Shuttle to the City within ten (10) days of the inception <br />of such policy by the insurance company. <br /> <br />Sec. 90.315. Issuance. <br /> <br />If the City Manager, or the Manager's designee, finds that the applicant meets all <br />the requirements of this article for shuttle service, the Director of Parks shall issue a <br />franchise stating the name and address of the applicant, the number of vehicles <br />authorized, the date of issuance, and a description of the approved route. <br /> <br />SECTION 2. The total number of franchises to be issued under this Article <br />is to be limited to eight. <br /> <br />SECTION 3. A River Shuttle annual franchise fee is established. The following <br />fee structure shall apply: <br /> <br />Gross revenues shall mean the gross amounts received for by the Franchisee for <br />the rental of water oriented recreational equipment and the operation of river shuttles. <br /> <br />For businesses whose gross revenue for the previous year was less than <br />$75,000.00, the fee shall be $250.00. <br /> <br />For businesses whose gross revenue for the previous year was greater than <br />$75,000.00 and less than $150,000.00. the fee shall be $500.00. <br /> <br />For businesses whose gross revenue for the previous year was more than <br />$150,000.00 but less than $500,000.00, the fee shall be $1,000.00 <br /> <br />For businesses whose gross revenue for the previous year was more than <br />$500,000.00, the fee shall be $2,000.00. <br /> <br />SECTION 4. All fees collected through river shuttle franchises shall be deposited <br />in a fund established for use by the Park Department. The use of these funds shall be <br />restricted to litter control, park ranger enforcement, parking and street repair for the <br />areas bordering the San Marcos River, and other bona fide San Marcos River Projects. <br /> <br />SECTION 5. If any word, phrase, clause, sentence, or paragraph of this <br />ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, <br />the other provisions of this ordinance will continue in force if they can be given effect <br />without the invalid portion. <br />
