<br />Once approved by the City Council, the records management plan shall be binding on all <br />offices, departments, division, programs, commissions, bureaus, boards, committees, or <br />similar entities of the City and all municipal records shall be created, maintained, stored, <br />microfilmed destroyed and/or disposed of in accordance with this record management <br />plan. <br /> <br />state law relating to the duties, other responsibilities, or record keeping requirements of a <br />department head do not exempt the department head or the records in the department <br />head's care from the application of this Section and the records management plan <br />adopted under it. Said law may not be used by the department head as a basis for refusal <br />to participate in the Records Management Program of the City of San Marcos, Texas. <br /> <br />Section 6. DESIGNATION OF RECORDS MANAGEMENT OFFICER AND RECORDS <br />COORDI NA TOR. <br /> <br />The City Clerk is the official records management officer for the City of San Marcos. Upon <br />the City Clerk's resignation, retirement, dismissal, or removal by action, the successor shall, <br />within 30 days after being appointed by the City Council, file the successor.s name with the <br />director and librarian of the Texas State Library and Archives Commission, as prescribed by <br />state law. <br /> <br />The record coordinator shall be appointed by City Clerk and approved by the City Manager <br />and the City Council to implement and administer the city.s records management program <br />in compliance with state law and under the supervision of the City Clerk. <br /> <br />The records coordinator manages the records management program under the direction of <br />the City Clerk. <br /> <br />Section 7. DUTIES AND RESPONSIBILITIES OF RECORDS MANAGEMENT OFFICER AND RECORDS <br />COORDI NA TOR. <br /> <br />In addition to other duties assigned by this chapter and state law, the records management <br />officer and records coordinator shall: <br /> <br />(a) administer the city.s records management program and provide advice <br />and assistance to department directors and their departments; and <br /> <br />(b) annually recommend and prepare for approval, by the records <br />management policy Committee, any new record retention <br />requirements, policies and procedures for the city.s records <br />management and disposition program; and <br /> <br />(c) in cooperation with department directors, identify essential records and <br />establish a records disaster and recovery plan for each department <br />to ensure maximum availability of the records in order to re-establish <br />operations quickly and with minimum disruption and expense; and <br /> <br />(d) monitor records retention schedules and administrative rules issued by <br />the Texas State Library and Archives Commission to determine if the <br />records management program and the city.s records retention and <br /> <br />Page 9 <br />
