107. <br /> <br />ORDINANCE NO. 2003 - 30 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS, TEXAS AMENDING <br />SECTIONS 86.003 AND 86.004 OF THE CITY CODE TO <br />REVISE REGULATIONS RELATED TO EXTENSIONS <br />AND CONNECTIONS TO THE CITY WATER AND <br />WASTEWATER SYSTEMS; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />RECITALS: <br /> <br /> 1. City Code Section 86.003 currently includes a policy under which the City pays for the <br />first 100 feet of a water or wastewater utility extension needed for a private development, unless the <br />City has not budgeted funds for this purpose in the Water-Wastewater Fund budget. The staff has <br />recommended that this policy be discontinned, since the City has not budgeted funds for City <br />contributions towards water or wastewater extension costs in many years, and the inclusion of this <br />policy gives rise to expectations on the part of developers that cannot be met. <br /> <br /> 2. City Code Sections 86.003 and 86.004 also provide for regulations and approval <br />procedures for extension and connection to the City water and wastewater systems by uses outside <br />the City limits. The staff has recommended that this policy be revised so that extension and <br />connection requests will be accompanied by am~exation requests to more effectively facilitate <br />annexation of areas to be served by City utilities befbm development occurs. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br /> SECTION 1. Chapter 86, Utilities, of the City Code is amended by revising Sections <br />86.003 and 86.004 as follows (underlining indicates added text; o'~'erztrikc indicates deleted text): <br /> <br />Sec. 86.003. Water and wastewater line extensions when no platting is required ..... '-'- <br /> <br />r~., ........................ ~ ~vWater or wastewater line extensions to serve <br />....................... ~ ........ for which no atting is required, ar_ge subject to the <br />following: <br /> <br /> (2) The extension must be of a size that conforms to the city's construction design and <br />materials standards and the provisions of the city master plan and capital improvements plans <br />adopted :m Sccticn !92.925 ofth:~s Ccdc that pertain to utility development, and the design and <br />construction of the extension must meet all state and city regulations. <br /> <br /> <br />
