ORDiNANCE NO. 2003- 3 2 <br /> <br />.-J b *-a >. ta AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />-~ ~ ~ ¢ MARCOS, TEXAS AMENDING CHAPTER 66, SOLID WASTE, OF <br /> '~ ~ THE CITY CODE TO PROVIDE FOR A FEE TO BE CHARGED TO <br /> ALL RESIDENCES FOR RECYCLING CENTER SERVICES; <br /> SETTING THE AMOUNT OF THE FEE; INCLUDING PROCEDURAL <br /> PROVISIONS; AND DECLARING AN EFFECTIVE DATE. <br /> <br />114. <br /> <br />RECITALS: <br /> <br /> 1. The City has previously provided for recycling center services under the City's agreement <br />with BFI Waste Services of Texas, L.P. for collection and disposal of residential solid waste and <br />recyclable materials, and the City wishes to contract for recycling center services separately fi'om the <br />solid waste contract. <br /> <br /> 2. The City has previously charged for the cost of recycling center services as a part of the <br />monthly solid waste charges to single-family and duplex residential units, and the City wishes to <br />spread the cost for recycling drop-off center services to all residences in the City, including multi- <br />family residential units, which are more likely to use recycling center services because curbside <br />recyclable materials collection is not available to them trader the City's solid waste contract. <br /> <br /> BE IT ORDAiNED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br /> SECTION 1. Sections 66.001, 66.026 and 66.028 of the City Code are mnended as follows <br />(underlining indicates added text, ,~ ......... indicates deleted text): <br /> <br />Sec. 66.001. Definitions. <br /> <br />In this chapter: <br /> <br />Bag means a plastic sack used to store garbage and rubbish. <br /> <br />Bin means a metal receptacle used to store refuse, designed to be lifted and emptied <br />mechanically. <br /> <br />Bulky waste includes appliances, furniture and other large waste materials, other than <br />construction debris, dead animals, hazardous waste or stable matter. <br /> <br />Construction debris means waste building materials resulting from construction, remodeling, <br />repair or demolition of buildings. <br /> <br />Dead animal rueans any dead animal or part of an animal other than those processed for <br />human use. <br /> <br />Garbage means decayable solid waste, including dead animals, animal and vegetable waste, <br /> <br /> <br />
