<br />.. (g'lA- <br /> -, <br />(E) Hold harmless, defend, and indemnify the City and its officers and employees from <br />and against all suits, claims and expenses, including attomey's fees, arising in connection <br />with work performed under this Contract. <br />(F) Commence work immediately upon execution of the Contract and complete the <br />same within five calendar days from the date the materials are received by the Contractor. <br />(G) Not discriminate against any person on the basis of race, color, religion, sex, <br />national origin, age or disability. <br />(H) Comply with all local, state and federal laws in performing the services under this <br />Contract. <br />(I) Provide the City with written warranties upon completion of the work in accordance <br />with the warranty descriptions in the Contractor's Proposal. <br />2. AGREEMENTS BY CITY <br /> City agrees to pay the Contractor Sixty Two Thousand, Two Hundred Ninety Seven <br />Dollars and no/100 ($62,297.00) upon Contractor's satisfactory completion of the Contract. <br />City will make payment to the Contractor within 20 days of the City's receipt of the invoice. <br />An early payment discount of the $797.00 will apply if the City pays the contract price <br />within 10 days of receipt of the invoice. <br /> . <br />3. WAGE RATE REQUIREMENTS <br /> <br /> Contractor understands that it must comply with all current Federal and State <br />of Texas wage laws, including of the Texas Prevailing Wage Rate Statute. This contract <br />will not bbe funded in whole or in part with Federal funds, and the provisions of the Davis <br />-Bacon and related acts will not apply. In accordance with State law, the Contractor will: <br />(A) Pay all laborers, workers and mechanics of all skills employed at the site to perform <br />work for not less than the general prevailing rate of per diem wages for work of a similar <br />character in the locality in which the work is performed and not less than the general <br />prevailing rate of per diem wages for legal holiday and overtime work <br />(B) The City has ascertained the general prevailing wage rate for each craft or type of <br />worker or mechanic needed to execute the Contract and the rates are attached as <br />Attachment "B". <br />(C) Contractor will forfeit as a penalty to City $60.00 for each laborer, worker or <br />mechanic employed, for each calendar day or portion of a day that the worker or mechanic <br />is paid less than the prevailing wage rates established in this Contract. <br /> 2 <br />
