' STATE OF TEXAS CITY OF SAN MARCOS CONSTRUCTION CONTRACT This Contract is made between the City of San Marcos, 630 East Hopkins, San Marcos, Texas (the "City") and San Marcos Air Conditioning, Inc., 106 Texas Avenue, Suite 2-A, San Marcos Texas, 78666 (the "Contractor"). , 1. AGREEMENTS BY THE CONTRACTOR ' Contractor agrees to: (A) Perform the labor necessary for the installation of a Trane RTAA125 Air-Cooled Chiller in accordance with the proposal dated May 2, 1997 (the "Proposal") attached as Attachment "A" (B) All work is to be performed in in a workmanlike manner in accordance with the specifications submitted by Contractor in its Proposal. (C) Upon execution of this Contract, provide the City at the address shown in this Contract a certificate of insurance evidencing at least the following levels of insurance . coverage: Coverage Minimum Limits ($) Comprehensive General Liability 250,000/500,000/100,000 Motor Vehicle Liability 250,000/500,000/100,000 Workers' Compensation Statutory - All insurance coverage except workers' compensation will name the City as an additional insured/or an insured, as its interests may appear. Insurance underwriters must be acceptable to the City. (0) Furnish the City with performance and payment bonds as security for the faithful performance and payment of all of its obligations under this Contract. These bonds will be in amounts at least equal to the Contract price and in the form attached as Attachments "cn and "0". The bonds shall be underwritten by a surety authorized to do business in Texas, and will bear the same date as, or a date subsequent to this Contract and the performance bond will extend for a period of one year beyond the date of the written acceptance of the work by the City. The current power of attorney for the person who signs for any surety company shall be attached to each of the bonds. The bonds will be with a surety satisfactory to the City. 1
