' <br /> STATE OF TEXAS <br /> CITY OF SAN MARCOS <br /> CONSTRUCTION CONTRACT <br /> This Contract is made between the City of San Marcos, 630 East Hopkins, San <br /> Marcos, Texas (the "City") and San Marcos Air Conditioning, Inc., 106 Texas Avenue, Suite <br /> 2-A, San Marcos Texas, 78666 (the "Contractor"). <br />, 1. AGREEMENTS BY THE CONTRACTOR <br />' <br /> Contractor agrees to: <br /> (A) Perform the labor necessary for the installation of a Trane RTAA125 Air-Cooled <br /> Chiller in accordance with the proposal dated May 2, 1997 (the "Proposal") attached as <br /> Attachment "A" <br /> (B) All work is to be performed in in a workmanlike manner in accordance with the <br /> specifications submitted by Contractor in its Proposal. <br /> (C) Upon execution of this Contract, provide the City at the address shown in this <br /> Contract a certificate of insurance evidencing at least the following levels of insurance <br /> . <br /> coverage: <br /> Coverage Minimum Limits ($) <br /> <br /> Comprehensive General Liability 250,000/500,000/100,000 <br /> Motor Vehicle Liability 250,000/500,000/100,000 <br /> Workers' Compensation Statutory <br />- All insurance coverage except workers' compensation will name the City as an additional <br /> insured/or an insured, as its interests may appear. <br /> Insurance underwriters must be acceptable to the City. <br /> (0) Furnish the City with performance and payment bonds as security for the faithful <br /> performance and payment of all of its obligations under this Contract. These bonds will be <br /> in amounts at least equal to the Contract price and in the form attached as Attachments <br /> "cn and "0". The bonds shall be underwritten by a surety authorized to do business in <br /> Texas, and will bear the same date as, or a date subsequent to this Contract and the <br /> performance bond will extend for a period of one year beyond the date of the written <br /> acceptance of the work by the City. The current power of attorney for the person who <br /> signs for any surety company shall be attached to each of the bonds. The bonds will be <br /> with a surety satisfactory to the City. <br /> 1 <br />
