<br /> - - 31(1; <br /> necessary at any time for the Project, including such auditing services as the City may <br /> require to ascertain how or for what purposes the Contractor used the money paid by or <br /> on behalf of the City. <br /> 2.7 Give prompt written notice to Engineer whenever City observes or otherwise <br /> becomes aware of any development that affects the scope or timing of Engineer's services. <br /> ARTICLE 3 <br /> PAYMENTS TO THE ENGINEER <br /> 3.1 PAYMENTS ON ACCOUNT OF BASIC SERVICES <br /> Payments for Basic Services will be made to Engineer monthly following receipt by <br /> City of Engineer's invoices in amounts based on the Cost Schedule attached as <br /> Attachment B to this Agreement. <br /> . . <br /> 3.2 PAYMENTS ON ACCOUNT OF ADDITIONAL SERVICES <br /> Payments on account of the Engineer's Additional Services as defined in Section <br /> 1.3 will be made monthly upon City's receipt of a copy of the executed Authorization of <br /> Change in Services Form and Engineer's statement of services rendered or expenses <br /> incurred, less any disputed amounts, pending resolution thereof. Invqice amounts will be <br /> based on the hourly billing rates specified in Attachment C to this Agreement. <br /> ARTICLE 4 <br /> ENGINEER'S RECORDS <br /> 4.1 All expense records of Engineer will be kept on a recognized accounting basis <br /> acceptable to the City and will be available to the City or the City's authorized <br /> representative at mutually convenient times. <br /> 4.2 The City and any federal and state agencies that have monitoring or auditing <br /> \ responsibilities for the Project will have access to any books, documents, papers and <br /> records of the Engineer which are directly pertinent to this Project for the purpose of <br /> making audit, examination, copying, and transcriptions. <br /> ARTICLE 5 <br /> OWNERSHIP AND USE OF DOCUMENTS <br /> 5.1 All documents prepared by the Engineer in connection with this Project will become <br /> the property of the City whether the Project is executed or not. However, Engineer will not <br /> be responsible, and liability is hereby waived by City against Engineer, and City will <br /> indemnify Engineer from any and all losses, claims, demands and causes of action <br /> resulting from City's use of these documents other than for the Project as contemplated <br /> 3 <br />
