<br /> ':....& . , <br /> . . 44 <br /> PROFESSIONAL ENGINEERING SERVICES <br /> AGREEMENT FOR THE CITY OF SAN MARCOS <br /> DRAINAGE UTILITY COST-OF-SERVICE STUDY <br /> This Agreement is made this the \D~ day of "")un-L , 19~ 7, <br /> between the City of San Marcos, Texas (the "City"), 630 East Hopkins, San Marcos, Texas <br /> 78666 and Alan Plummer Associates, Inc. (the "Engineer"), 7524 Mosier View Court, <br /> Suite 200, Fort Worth, Texas 76118-7110, for engineering services in conneCtion with the <br /> - City's Drainage Utility Cost-of-Service Study (the "Project"). <br /> 1 <br /> The City and the Engineer agree as follows: <br /> ARTICLE 1 <br /> ENGINEER'S SERVICES AND RESPONSIBILITIES <br /> 1.1 STANDARDS OF PERFORMANCE <br /> 1.1.1 Engineer will be responsible for the proper, accurate and adequate performance <br /> of all services in connection with this Agreement. All services performed by the Engineer <br /> under this Agreement will be by persons appropriately licensed or registered under State <br /> laws governing the practice of engineering. The Engineer will use that degree of c~re and <br /> skill ordinarily exercised for similar projects by professional engineering firms of national <br /> caliber who possess special expertise in the type of work involved in this Project. No work <br /> under this Agreement will be subcontracted by the Engineer without prior written approval <br /> from the City. Any work or services subcontracted hereunder will be specified by written <br /> agreement and will be subject to each provision of this Agreement. <br /> 1.1.2 Any provisions in this Agreement pertaining to the City's review, approval and/or <br /> acceptance of documents, or other written materials prepared by Engineer and/or its <br /> consultants, contractors, and subcontractors in connection with this Project will not diminish <br /> í Engineer's responsibility therefor. <br /> <br /> i <br /> - 1.1.3 Engineer will perform its services in coordination with the City. Engineer will meet <br /> with City representatives as necessary throughout the duration of the Project at mutually <br /> convenient times. <br /> The Engineer's Basic Services consist of Task 1 through Task 6, as described in Sections <br /> 1.2 through 1.7 of this Agreement. <br /> 1.2 TASK 1-PROJECT MOBILIZATION <br /> The Engineer will conduct up to two City Council workshops and meet with City staff <br /> to: <br /> 1 <br />
